ملخص بحث اختيار جنس الجنين في ضوء الفقه الإسلامي
الحمد لله الذى بنعمته تتم الصالحات ، وبفضل جوده تنعم الموجودات ، وکما حمدته سبحانه وتعالى فى المقدمة أحمده سبحانه فى الخاتمة ، وأشکره على توفيقه ، وبعد ،
فهذا موضوع "اختيار جنس الجنين في ضوء الفقه الإسلامي " قد أتى على نهايته بعد توفيق من الله سبحانه وتعالى ، وأرجو الله تعالي أن يکون بالتوفيق قد حالفني ، وعن الخطأ والزلل قد جانبني ، إنه سبحانه سميع قريب مجيب ، وقد بدا لى بعض النتائج التى توصلت إليها من خلال بحثى تتمثل فيما يلى:
ــ أن معني الجنين في اصطلاح الفقهاء لا يخرج معنى الجنين في اصطلاح الفقهاء عن المعنى اللغوى وهو الولد ما دام في البطن غير أن الفقهاء اختلفوا فيما يصدق عليه لفظ الجنين حال سقوطه وقبل تمام خلقه ونفخ الروح فيه .
ــ يراد باختيار جنس الجنين : ما يقوم به الزوجان من الأعمال والإجراءات الطبيعية بنفسيهما أو الطبية من خلال مختص بهدف تحديد ذکورة الجنين أو أنوثته .
ــ يقرر علماء الوراثة بأن عملية تحديد جنس الجنين من الناحية التکوينية تعود إلي التقاء زوجين من الصبغيات (الکروموسوم) علي وفق ترتيب معين ينتج عنه المولود الذکر وترتيب آخر ينتج عنه المولود الأنثي .
ــ شغل أمر تحديد جنس الجنين ومعرفة نوعه شعوبا وأجناسا شتَّى على مرِّ التَّاريخِ ، فميل البشر إلي إنجاب الذکور دون الإناث کان ميزة تميز کل الحضارات تقريبا ، ولهذا ظهر وأد البنات في الحضارات القديمة وحتي عند العرب قبل بزوغ فجر الإسلام.
ــ اختلف العلماء في حکم اختيار جنس الجنين من الناحية العقائدية وقد اخترنا الرأي القائل : بأن ادعاء معرفة جنس الجنين ليس تطاولا علي مشيئة الله وإرادته ولا من ادعاء علم ما في الأرحام لقوة ما استدلوا به ؛ ولأن عملالإنسان في اختيار الجنس لا يخرج عن المشيئة الإلهية بل هو تنفيذلها فالإنسان يفعل بقدرة الله ويشاء بمشيئة الله .
ـ يجوز اختيارُ جنس الجنين بالطرق الطبيعية ؛ کالنظام الغذائي، والغسول الکيميائي، وتوقيت الجماع بتحري وقت الإباضة؛ لکونها أسباباً مباحة لا محذور فيها
ــ  اتفق العلماء المعاصرون علي أنه لا يجوز اختيار جنس الجنين علي نطاق الدول والمجتمعات ؛ لأنه يؤدي إلي الإخلال بالنواميس الکونية ، ولأن فيه تفضيل جنس علي جنس ، فهو مضاهاه لفعل أهل الجاهلية .
ــ  اختلف الفقهاء المعاصرون في حکم اختيار جنس الجنين علي مستوي الأفراد بالوسائل المخبرية وقد اخترنا الرأي القائل : بجواز اختيار جنس الجنين لقوة ما استدلوا به ، وهذا الجواز مقيد بشروط منها : أن تتوافر الدواعي والأسباب عند الأسرة لاختيار جنس المولود ، وأن تتخذ الاحتياطات اللازمة لمنع اختلاط هذه الخلايا بغيرها ،  وأن يتم هذا الاختيار بين خلايا جنسية مأخوذة من زوجين حال حياتهما .
ــ حظرت غالب التشريعات الوضعية إلي عدم اختيار جنس الجنين بصفة عامة ، سواء أکان علي المستوي الفردي أم الجماعي إلا لأسباب طبية .
ــ  بينت اختلاف الفقهاء في حکم إتلاف البويضات الملقحة الزائدة عن الحاجة واخترت الرأي القائل بجوز إتلاف البويضات الملقحة الزائدة عن الحاجة فتترک دون عناية إلي أن تنتهي حياتها علي الوجه الطبيعي لقوة ما استدلوا به ؛ ولأن هذا لا يعد إجهاضاً، حيث إن النطفة لم تستقر في الرحم
ــ لم ينص القانون المصري علي إتلاف البويضات الملقحة الزائدة عن الحاجة وهذا يعني أن هناک فراغا تشريعيا ، وبالتالي ليس هناک مفر من الرجوع إلي القواعد العامة ، وبالرجوع إلي تلک القواعد نجد أن نصوص قانون العقوبات لا تخطئ الاعتداء علي البييضات المخصبة خارجيا حيث إنها تحمي الجنين في بطن أمه فقط

The topic "Influencing the sex of the fetus in the light of Islamic Jurisprudence" has been concluded by the benevolence of Allah Almighty, and all the credit for this work ascribes to Allah Almighty while any errors and omissions must be attributed to my person, the conclusions I have reached through the research are as follows:

That the meaning of fetus in the terminology of jurists is the same as its common literary meaning, which is a child in the abdomen of a mother, then again there is difference of opinion among scholars as to applicability of the same word on a fetus when a miscarriage has occurred before its full creation and enlivening.
The choice of the sex of the fetus: This encompasses the procedures couples go through, whether they are natural or artificial, performed individually or by medical specialists, for the purpose of determining or influencing the sex of the fetus.
Geneticists report that the sex of the fetus is determined by a pair of chromosomes from both parents, a specific order results in the birth of a male while another arrangement produces a female child.
The function of accurate determination and influencing of the sex of the fetus has been in focus throughout history, the tendency of humans to prefer boys over girls has been common in almost all civilizations, and has existed in ancient civilizations and even in the Arabs before the dawn of Islam.
There exists a difference of opinion among the scholars regarding the rule on choice of the fetus's sex from the point of view of religious belief. We have opted the opinion that the claim of knowledge of the sex of a fetus is not an extension of Allah's will, and any claim of such knowledge is of no legal significance. And any human effort to determine the sex of the fetus does not preclude the will of Allah rather it is the implementation of his will.
It is permissible to use natural methods to choose the sex of the fetus, such as diet, bathing salts, the timing of sexual intercourse by examining the time of ovulation, because these are permissible means and not prohibited in Islam.
Contemporary scholars have agreed that it is prohibited to choose the sex of the fetus on the scale of states and societies, because it leads to violation of universal laws, and because the preference of one sex on the other is identical to the practice of the people of ignorance.
The modern jurists differed in the ruling on the choice of the sex of the fetus at the level of individuals by means of laboratory tests. We have chosen the opinion that it is permissible to choose the sex of the fetus for the force of its proponent’s arguments, the opinion is restricted by conditions such as: there are sufficient reasons in the family to choose the sex of the child, and precautions are taken to prevent the mixing of these cells, and these precautions are practiced by a couple in their sex lives.
Most of legal systems prohibit the selection of sex of a fetus in general as well as at individual and collective levels; the only exception is medical reasons.
The jurists have differed on the question of destroying the redundant over-fertilized ova, and I have chosen the view that it is permissible, but it must be left without nourishment until its life has naturally run its course, and because this does not amount to an abortion, since the since the sperm did not settled in the womb.

The Egyptian law does not provide for the destruction of over-fertilized ova. This means that there is a legislative vacuum, and therefore there is no escape from reverting to the general rules. In reference to these rules, we find that the provisions of the Penal Code do not apply on externally fertilized eggs, as they protect the fetus in the belly of his mother
