الملخص :
تعد المحكمة الجنائية الدولية أحد الأجهزة الدولية التي تتمتع باستقلالية تامة دولياً، ومن خلالها يتم محاكمة الأفراد المرتكبين للجرائم الأشد خطورة التي تختص بنظرها هذه المحكمة على المستوى الدولي، ولأن الجرائم التي تختص بنظرها هذه المحكمة ذات خطورة عالية وترتبط في الأغلب بمن يشغل الوظائف الكبرى في الدول كالرؤساء والوزراء، لذا فإن طبيعة عمل المحكمة وإن كان قضائياً خالصاً إلاّ أن السياسة ستكون حاضرة في المشهد العالمي أثناء المحاكمة لارتباطها الوثيق بأصحاب هذه الوظائف الكبرى، مما يبرز الأهمية الكبرى لبحث مبادئ المحاكمة التي وضعها النظام الأساسي للمحكمة الجنائية، ومقارنة ذلك بأحكام الشريعة الإسلامية، وتقديم بحث مقارن لموضوع حيوي قانوني قضائي سياسي يثري بحول الله المكتبة العلمية الفقهية.

 The Basic Principles for Trial opposite to the International Criminal Court.

Abstract:
The International Criminal Court (ICC) is considered one of the international institutions that is internationally has a  completely  independence, where warranted, tries individuals charged with the crimes of concern to the international, Whereas  who commit the most serious crimes that this court is competent to consider at the international level are represent high risk , and majorly joined with persons  who occupy major positions in countries. Like presidents and ministers, so the nature of the court’s work, even if it is purely judicial, politics will be present in the global scene during the trial because of its close association with the holders of these major positions, which highlights the great importance of examining the principles of trial established by the statute of the criminal court. Comparing this with the provisions of Islamic Sharia, and presenting a comparative research on a vital legal, judicial, and politically that, enrich  the jurisprudence scientific library with God's help < /p>
