الحمد لله الذي قيض للأمة علماء وضعوا للشريعة أصولها لتكون سبيلا لاستنباط الأحكام ، والصلاة والسلام على الرحمة المهداة نبينا محمد صلى الله عليه وسلم ....وبعد
فيهدف هذا البحث إلى بيان المقصود بالشروع والمسائل المرتبطة به من خلال تعريفه وتميز ما يخالطه من مصطلحات، ووجه التباين فيها، واستقراء العديد من المسائل الأصولية وطيدة الصلة والارتباط بالشروع؛ وتسليط الضوء عليها كمقدمة لتخريج الفروع المرتبطة بها، وتأثير الشروع فيها، ومناقشة تلك المسائل وتأصيلها.
والشريعية الإسلامية تبنى على الأصول والمبادئ الثابتة والتي من شأنها أن تكون مرجعا لضبط الأحكام وتحريجها على مقتضى الأسس التى بنيت عليها.
        وقد تناولت في هذا البحث أثر الشروع في الواجبات بأنواعها ونبهت على مدى اختلاف العلماء في إتمام الشروع في الواجب المخير اعتبارا بأغلظ الأحوال أو بحال الوجوب، وأن الواجب الكفائى يختلف عن العينى في مجمله عند الشروع فيه ؛حيث رجحت القول بإتمام الواجب الكفائى بما يرتبط به من القرائن والملابسات الموجبة للاتمام فلا يكون له حكما مطلقا؛ كذلك بينت حكم تعين السنة الكفائية بالشروع فيها وإتمام المندوب بعد الشروع ،مع ترجيح الحيطة لما تأكد منه وأولوية إتمام ما شرع فيه من الطاعات لغير عذر، كذلك بينت حكم الشروع فيما زاد على قدر الواجب وارتباطه بحكم إتمام المندوب ، والشروع فيما فيه صفة الكراهة ، وحققت نفى المباح عند الكعبى وارتباطه بالشروع ثم زيلت ذلك بعدة مسائل أخرى في البيان، والنسخ ،والعمل بفتوى المفتى وأثر الشروع فيها.

Praise be to God, who gave the nation scholars who put the law of the law to be a way to derive rulings, and prayers and peace be upon the mercy of our Prophet Muhammad, may God bless him and grant him peace ....
This research aims to explain what is meant by the initiation and related issues through its definition and the distinction of the terms it mixes, and the contradiction in it, and an induction of many fundamentalist issues that are closely related and related to the initiation; And highlight it as an introduction to the graduation of the associated branches, the impact of the initiation of them, and the discussion and rooting of these issues.
And Islamic law is based on the principles and fixed principles that would be a reference to controlling judgments and their prohibition on the requirements of the foundations on which they were built.
In this research, I dealt with the impact of the attempt to duties of all kinds and alerted the extent of scholars to complete the initiation of the invisible duty as of the thickening of conditions or the case of obligatory, and that the competency duty differs from the eyes in its entirety when initiating it, where I suggested that the completion of the competency duty is associated with it The clues and circumstances that are for completion, so it does not have an absolute judgment; It also showed the ruling of the appointment of the sufficiency year to start it and the completion of the delegate after the initiation, with the weighting of the caution for what was confirmed by it and the priority of completing the obedience to it without excuse, as well as the ruling on the initiation of the extent of the duty and its association with the virtue of the completion of the delegate, and the initiation of the attribute of hatred, and achieved He denied the permissibility with Al -Kaabi and its association with the attempt, then I removed it with several other issues in the statement, copying, working on the Mufti fatwa and the effect of the attempt to it.
