الحمد لله والصلاة والسلام على من لا نبي بعده:
هذا البحث عنوانه: "المصلحة وأثرها في فتاوى الشيخ ابن عثيمين رحمه الله" يؤکِّد أنَّ ديننا الحنيف راعى في أحکامه الشرعية المصالح المنضبطة غير المخالفة للکتاب والسنة؛ دفعًا للحرج عن الناس.
وانتظم في مبحثين رئيسين، المبحث الأول: يوضح معنى المصلحة، ويقيم الأدلة على حجية المصلحة المرسلة، وأنَّ المذاهب الفقهية تعمل بها، بعد تحقق الضوابط الواجب توفرها فيها، وفي هذا المبحث تقسيم المصلحة إلى: مصلحةٍ معتبرةٍ (شهد الشرع لها بخصوصها)، ومصلحةٍ ملغاةٍ (وهي مصلحة موهومة، مصادمة للنص أو الإجماع أو القياس الجلي)، ومصلحةٍ مرسلةٍ (لم يرد نصٌّ معيَّنٌ باعتبارها ولا بإلغائها).
والمبحث الثاني: في بيان موقف الشيخ ابن عثيمين من المصلحة المرسلة، وکيفية تعامله معها في المسائل التي تحتاج إلى نظرٍ مصلحي أو استصلاحيٍّ، وخُتِم هذا المبحث بتطبيقات المصلحة على الفروع الفقهية، من خلال فتاوى الشيخ ابن عثيمين رحمه الله.  والله الموفق.
 
 


Abstract
All praise is for Allah and prayers and peace be upon the final prophet.
This research is entitled: " 'Interest'   and its impact in the fatwas of Shaykh Ibn 'Uthaymeen (may Allaah have mercy on him)" highlighted that our true religion takes into account in its rulings the 'regulated interests' that are not contrary to the Quran and Sunnah. In order to eradicate people's general misconception, two sections have been organized.
The first section clarifies the meaning of the 'interest' and assesses the evidence of the validity of the 'sent interest', and that the doctrines of jurisprudence work in it after achieving the necessary requirements. (Textual, consensus or clear analogy), and a sent interest (no particular text is cited as repealed).
The second topic: Elaboration of the position of Sheikh Ibn Uthaymeen of the 'sent interest', and how to deal with it in matters that need to be considered reformative or remediable , and in the conclusion the  applications 'interest' on the branches of jurisprudence is shown, through the fatwas of Sheikh Ibn Uthaymeen Allah's mercy be on  him.  May the Almighty bless us all.
