ملخص البحث
- الطّفل هو الصّغير ما لم يبلغ و إن کان جنينا، و هو تعريف يتفوّق على التّعريف الوارد في أغلب المواثيق الدّوليّة باعتبار أنّ الطّفل هو ( کلّ إنسان لم يبلغ الثّامنة عشرة سنة) لأنّ تحديد بداية الطّفولة بالميلاد فيه إهمال للمرحلة الجنينيّة و نهايتها بسن الثّامنة عشرة يتعارض مع القواعد العلميّة للتقسيمات العمريّة خاصة علم نفس النّمو،  بالإضافة إلى تأخير المسؤوليّة الجنائيّة للشّخص البالغ فکل شخص أقلّ من ثمانية عشر سنــــــة و لو بيوم واحد لا يحاسب و لا يعاقب، و إذا ما عُوقب تکون العقوبة مخففّة و هو أمر ممجوج ساعد في انتشار جرائم الأحداث و تنوّعها لعدم ردعيّة العقوبات التي تطبّق عليهم،  و من القضايا المؤلمة التي ترتبط بهذا الموضوع .
و حقوق الطّفل التي منحها الإسلام للطّفل تشمل الطفل في جميع مراحله و تتفوّق على ما تحصّل عليه طفل القرن الععشرين في اتّفاقيّة حقوق الطّفل
و هو ما يبرز  أنّ الشّريعة الإسلاميّة صالحة لکلّ زمان و مکان  وأحکامها تستوعب کلّ جديد إلى أن يرث الله الأرض و من عليها.
 
 
Abstract
 
A child is a young child unless he or she is a fetus, a definition that surpasses the definition contained in most international conventions, since the child is (every person under the age of 18 years) because determining the beginning of childhood by birth neglects the embryonic stage and ends at the age of eighteen With the scientific rules of age divisions, especially the growth psychology, in addition to delaying the criminal responsibility of the adult person. Every person under eighteen years of age, if one day, is not held accountable or punished. If punished, the penalty is mitigated. And their diversity for lack The deterrent penalties imposed on them, and the painful issues related to this subject.
The rights of the child granted by Islam to the child include the child at all stages and is superior to what the child of the twenty-first century of the Convention on the Rights of the Child
And it highlights that Islamic law is valid for all time and place and its provisions absorb all new until God inherits the land and from it.
