أحكام السياسة الشرعية المتعلقة بمرض كورونا

ملخص البحث:
تهدف هذه الدراسة إلي بيان مكانة السياسة الشرعية العظيمة في الإسلام، وما ترتب عليها من تشريعات، وأحكام،العلاقة الوثيقة بين السياسة الشرعية والأحكام الفقهية، الجدل الواسع حول خضوع العبادات وغيرها من الأحكام للسياسة الشرعية.
 
النتائج:

السياسة الشرعية: كل فعل أو قول من ولي الأمر الشرعي أو من ينوب عنه صادر عن مصلحة معتبرة شرعاً، لم يرد فيه نص خاص، أو كان من الأمور التي من شأنها أن لا تبقى على وجه واحد.
مجالا السياسة الشرعية: أحكام الوقائع التي ليس فيها نص خاص صريح من الكتاب أو السنة أو الإجماع، وليس له أصل ثابت بنص يقاس عليه. الثاني: الأحكام التي تختلف باختلاف العصور والأحوال، وتتبدل بتبدل المصالح.
وباء كورونا: عبارة عن فصيلة كبيرة من الفيروسات التي تسبب أمراضاً متنوعة للإنسان كنزلات البرد والزكام ومتلازمة كورونا الشرق الأوسط التنفسي، ومتلازمة الالتهاب الرئوي الحاد الوخيم.

التوصيات:

توعية الناس بدور الشريعة في القضاء على الأوبئة.
عمل المزيد من الأبحاث الفقهية المتعلقة بوباء كورونا وغيره من الأمراض سريعة الانتشار.
عمل مشروع فقهي خاص بكل ما يتعلق بالأوبئة من أحكام، وتوزيعه على طلاب الماجستير والدكتوراه.

Provisions of legal policy related to Corona disease

Abstract:
This study aims to show the great status of Sharia politics in Islam, and the consequent legislations and rulings, the close relationship between Sharia politics and jurisprudential rulings, the wide debate about the subjection of acts of worship and other rulings to Sharia politics.
 
Results:
Shari’a policy: every act or statement of the legitimate guardian or his representative emanating from a legitimate interest, for which there is no special text, or it was among the matters that would not remain in one way.
- The areas of Sharia politics: rulings on incidents that do not have a specific explicit text from the Book, the Sunnah, or consensus, and do not have a proven basis with a text that can be measured against. The second: rulings that differ according to eras and conditions, and change according to the change of interests.
Corona epidemic: It is a large family of viruses that cause various diseases in humans, such as colds and flu, Corona Middle East Respiratory Syndrome, and Severe Acute Respiratory Syndrome.
Recommendations:
- Educating people about the role of Sharia law in eliminating epidemics.
- Doing more jurisprudence research related to the Corona epidemic and other rapidly spreading diseases.
- Preparing a jurisprudence project on all matters related to epidemics, and distributing it to master's and doctoral students.
