قبول الآخر في الشريعة الإسلامية " الزواج بالكتابية وحسن عشرتها نموذجا "

ملخص البحث :
قبول الآخر بمحاورته والإحسان إليه وترك حرية التدين له، دون الرضا بدينه أو مخالفة الشريعة، ومن تطبيقات ذلك إباحة التزوج بنساء أهل الكتاب، ويلي عقدها وليها غير المسلم، وللزوجة الكتابية حقوق الزوجية كالمهر والنفقة والقسم وحسن العشرة كمحبة الزوج لها المحبة الطبيعية الدنيوية، ولا يمنعها من صلة أرحامها ولا من ممارسة شعائر دينها ولا خروجها إلى دور عبادتها، ولا من فعلها ما يبيحه لها دينها كأكل لحم الخنزير أو شرب الخمر لكن بالقدر الذي لا يسكر، وينبغي عليها مراعاة شعور زوجها المسلم، وله إلزامها بالغسل من الحيض لا غسل الجنابة، ويلزمها بالنظافة وتجنب الروائح الكريهة، وله أن يبدأها بالسلام ويرده عليها ويشمت عطاسها ويهنئها في المناسبات الاجتماعية والدينية بما يباح شرعا ورقيتها، وتثبت لها الحضانة وبر أولادها المسلمين بها، ويجوز للزوج الهبة والوصية والوقف لها، وقبوله ذلك منها، وله أن يشارك في تشييع جنازتها.

Abstract:
Acceptance of the other by talking to him and benevolent to him and leaving the freedom of religion to him, without accepting his religion or violating the law, and among the applications of that is the permissibility of marrying the women of the People of the Book, and her contract is followed by her non-Muslim guardian, and the book wife has marital rights such as the dowry, maintenance, oath, and good treatment, just as the husband’s love for her is the natural, worldly love, and it does not prevent her From the upholding of her wombs, nor from practicing the rituals of her religion, nor from going out to her places of worship, nor from doing what her religion permits, such as eating pork or drinking wine, but to the extent that does not intoxicate. Cleanliness and avoiding bad smells, and he may start her with greetings and return it to her, and smell her sneezing, and congratulate her on social and religious occasions in what is permissible according to Sharia and her kindness, and prove to her the custody and dutifulness of her Muslim children to her The husband may make a gift, bequest, and endowment for her, and his acceptance of that from her, and he may participate in her funeral.
