ملخص البحث:
     يركز البحث على مسألة من أهم المسائل في باب الاثبات، ومنهج الفقه الإسلامي في إثبات قضايا الجرائم أو نفيها، سواء كانت جرائم معلومة الجاني، ببيان دليل من أدلة الاثبات ألا وهو نصاب الشهادة الواجب تحققه لتثبت به القضية حقا أو تدفع باطلا، حرصاً على إنارة طريق العدالة، وإزالة العوائق التي تعترض سيرها، وقد تم البحث فيه عن واقع الشهادة وشروطها، والقصاص وأنواع الجرائم والحدود التي يحكم فيها بالقصاص، والموقف من شهادة الصبي والمرأة في جرائم الحدود والقصاص، ببيان آراء المانعين والمؤيدين والترجيح بينهما. ومن أهم النتائج التي توصلت إليها أن نصاب الشهادة يقطع السبيل أمام من لا يراقبون الله فيما يدلون به من شهادات قد تؤدي إلى إعدام نفس بريئة، أو تبرئة مجرم خطير، بيان أهمية الشهادة باعتبارها من أهم أدلة الإثبات التي يعتمد عليها القضاة في أحكامهم، فبها تقام الحدود، وتصان الدماء، وتحفظ الأموال، وكافة الحقوق، بيان المقصود بجرائم الحدود والقصاص والفرق بينهما، مقصود الشهادة: المشاهدة المعاينة، وبيان نصاب الشهادة وشروطها في جرائم الحدود والقصاص.

Abstract:
This research focuses an issue of one of the most important matters in the chapter on proving cases, which is the direction of Islamic jurisprudence in its approach to proof, by stating the quorum of testimony that must be achieved in order to establish the case as true or ward off falsehood, especially in the chapter on crimes, in order to illuminate the path of justice, and remove the obstacles that stand in the way.Its course, and the research on the reality of testimony and its conditions, retribution and the types of crimes in which retribution is judged, and the position on the testimony of boys and women in retribution crimes, by stating the opinions of those who oppose and support them, and the weighting between them. One of the most important findings that I reached is that the quorum of testimony prevents those who do not watch God from giving testimony that may lead to the execution of an innocent soul, or the acquittal of a dangerous criminal. Explaining the importance of testimony as it is one of the most important pieces of proof that judges rely on in their rulings. Punishments, bloodshed, property, and all rights are preserved. Explaining what is meant by hudud crimes and retaliation and the difference between them. The purpose of testimony: witnessing, inspection, and explaining the quorum of testimony and its conditions in hudud crimes and retaliation.
