ملخص البحث:
الأهداف: تهدف الدراسة إلى بيان المقصود بـمصطلح «عدم الحرج»، والمعاني التي ترد عليه وذلك من خلال استقراء بعض المسائل الأصولية وبعض التطبيقات الفقهية التي ورد فيها ذكر هذا المصطلح. النتائج: تبين أن مصطلح «عدم الحرج» لفظ مشترك؛ لأنه يطلق على الواجب والمندوب والمباح والمكروه على قول، وإنما يتعين واحد من المذكورات حسب السياق المذكور فيه، وهو مرادف لمصطلح «الجواز»، «عدم الإثم»، وحتى يتبين المراد منه لا بد أن نعرف هل المقصود به: عدم الحرج في الفعل فيشمل المندوب والمباح، أم عدم الحرج في الفعل والترك معًا فيشمل المباح فقط. الخلاصة: بيان مصطلح «عدم الحرج»، من خلال ذكر بعض المسائل الأصولية التي ورد فيها ذكره، وبعض التطبيقات الفقهية من كتب المذهب، وبين علاقته الوثيقة بالحكم الشرعي التكليفي، ومعانيه المحتملة لعدة أوجه.

ABSTRACT:
Objectives:  This study aims at clarifying what is meant by the term of " non-embarrassment" and the meanings which are responding to it, through extrapolating and some fundamentalist issues and some Figh applications which mentioned in this term.Results:  It is found that "non-embarrassment" is common word because it is called at the obligatory, the recommended, the permissible and the disliked according to a saying, but one of the aforementioned is specified according to the text in which is mentioned and it is synonymous with the term "permissibility" " non-sinning" and in order to clarify what is mentioned by it. To clarify what is wanted, we should know what is meant by it."Non-embarrassment" in actions includes the recommended and the permitted. "Non-embarrassment" in do or leave it includes only permissible.Conclusion: Clarifying the term of "non-embarrassment" through mentioning some of the fundamental issues which are mentioned before and some Figh applications from Madhab's books and its close relationship with Islamic ruling and its possible meaning for several aspects.
