مشكلة الدراسة: جاءت الدراسة لمعرفة احتمالية تأثير الرأي العام على الدعوى الجزائية ومعرفة مدى ذلك التأثير إن وجد، وعليه؛ تكمن مشكلة الدراسة في التساؤل الرئيس: ما هو مدى تأثير الرأي العام على سير الدعوى الجزائية في النظام السعودي؟ منهج الدراسة: تناول الباحث في دراسته المنهج التحليلي الوصفي المقارن؛ وذلك من خلال توضيح الحالات التي تكون محلًا للتأثير الإعلامي، مع توضيح مراحل التأثير الإيجابي والسلبي على مراحل الدعوى الجزائية، مع ذكر بعض الأمثلة والشواهد لإثراء الفكرة وتوضيح المعنى. من أهم النتائج: حرية الرأي العام، ونزاهة القضاء وحَيْدَتُه، وحق المتهم في محاكمة عادلة ركائزُ أساسية يقوم عليها البنيان الاجتماعي، التناول الإعلامي للمحاكمات الجزائية وسيلة من وسائل الكشف عن الحقيقة، وإفهام المجتمع بما يدور داخل أروقة المحاكم، كونه أحد مظاهر التعبير لحرية الرأي العام، التناول الإعلامي أحد صور علانية المحاكمات الجزائية، وليس مظهرها الوحيد، لذا يمكن أن يتم حظر تناول ما تم في الجلسة العلنية أو السرية، ومن أهم التوصيات: إنشاء هيئة وطنية للإعلام القضائي برئاسة رئيس المجلس الأعلى للقضاء، يكون هدفها وضع الضوابط النظامية والمعايير الإعلامية لنشر المحاكمات الجزائية، تحديد بعض أنواع الدعاوى الجزائية التي لا تكون محلًا للتناول الإعلامي كجرائم الاغتصاب ودعاوى الأنساب.

Study Problem: This study is based on the main question: What is the extent of public opinion's influence on the progress of criminal proceedings in the Saudi system? Research Methodology and tools: The researcher tackled the comparative descriptive analytical method by clarifying the cases that are subject to the media influence, and clarifying the stages of the positive and negative influence on the stages of the criminal case, with some examples and evidence to enrich the idea and clarify the meaning.Main Results:Freedom of public opinion, impartiality and impartiality of the judiciary, and the right of the accused to a fair trial are fundamental pillars of social structure, Media handling of criminal trials is a means of revealing the truth, and understanding the community within the courts, as one of the manifestations of freedom of public opinion, Media handling is one of the public images of criminal trials, not their only appearance, so it can be prohibited to deal with what was done in public or private meeting.
Main Recommendation:Establishment of a national judicial information body headed by the President of the Supreme Council of the Judiciary, whose objective is to establish regulatory regulations and media standards for the publication of criminal trials, Determining some types of criminal cases that are not subject to media treatment such as rape, misrepresentation and genealogies.
