ملخص البحث:
هدفت الدراسة إلى تقرير الحكم الفقهي في مسألة (زكاة الخَضْراوات والفواكه) وبيان أثر ذلك،وتضمّن البحث بيان المراد بمسألة (زكاة الخَضْراوات والفواكه)وتبيين الحكم الفقهي والنظامي لها، واتبعت الدراسة المنهج التحليلي، ومن أهم النتائج التي توصلت إليها: الخضروات والفواكه من جملة النباتات البرية، وبينهما اتفاق وافتراق من حيث التمييز بينهما، مسألة حكم زكاة الخضروات والفواكه تندرج في مسألة زكاة الخارج من الأرض، حكم زكاة الخضروات والفواكه دائر بين المثبتين والنافين، الحكم يدور مع علته وجوداً وعدماً، يجوز الأخذ بالقول المرجوح عند الاقتضاء، جريان السياسة الشرعية في مسألة حكم زكاة الخضروات والفواكه، مسألة حكم زكاة الخضروات والفواكه آثار ونوازل. وخلصت النتائج إلى مراعاة فقه الواقع في حكمها، وأوصت الدراسة بـإعادة النظر في هذه المسألة في هذا الوقت لدى الجهات الشرعية والنظامية، ودعوة المزارعين إلى إخراج زكاة الخضروات إلى إخراج الزكاة منهما؛ خروجاً من الخلاف، وإبراء للذمة، وشكراً للنعمة، وإحساناً لأهلها.

(Zakat on Vegetables and Fruits - Comparative Jurisprudential Study)

Abstract:
The purpose of the study was to ascertain and explain the jurisprudential ruling on the subject of zakat on fruits and vegetables and to expatiate on its impact. Moreover, the research’s investigative approach involved defining the meaning and significance of Zakat on fruits and vegetables as well as elucidating its jurisprudential and regulatory ruling.Remarkably mentioned,  the study followed an analytical approach, Among the most important findings that I reached: Vegetables and fruits are among the wild plants, and there is agreement and disagreement between them in terms of distinguishing between them. The issue of the ruling on zakat on vegetables and fruits falls within the issue of zakat on what comes from the earth. The ruling on zakat on vegetables and fruits revolves around those who affirm and deny it. The ruling revolves around its cause, whether it exists or not. It is permissible to adopt the more likely opinion when necessary, the flow of legal policy on the issue of the ruling on zakat on vegetables and fruits, the issue of the ruling on zakat on vegetables and fruits, effects and catastrophes.and the results concluded the consideration of the practical jurisprudence in its ruling. The study recommended a reconsideration of this issue at the present time by the religious and regulatory authorities, Calling on farmers to pay zakat on vegetables, to pay zakat on them; A way out of disagreement, a release of responsibility, gratitude for the blessing, and benevolence to its people.
