ملخص البحث
تعددت صور وأساليب حق الرأي والتعبير بين الکتابة واللفظ والإشارة والرسم وغيرها، وعلى ذلک ظهرت أهمية ممارسة هذا الحق، فهو من أهم الحقوق المؤثرة في حياة الفرد والمجتمع، لما له من تأثير کبير على ظهور الأفکار وتبادل المعلومات ومحاربة الفساد مما يؤدي إلى ازدهار الحضارات ورقيها، وهذا ما جعل الدول تتسابق (إما طواعية أو قسراً) إلى الاهتمام به بتنظيمه وتحديد إطاره وضوابطه، فالحق ليس مطلقاً بل هو مقيد بعدم الاعتداء على ثوابت المجتمع، وذلک حتى لا يتحول هذا الحق إلى وسيلة هدم للإنسان والمجتمع.
وعلى ذلک فإن قضية حرية الفکر والرأي من أکثر القضايا إثارة للجدل، فنجد مفکرين يتشددون في تقريرها، وآخرين يتبنون مفهوم واسع(غربي) لهذا الحق معتقدين بأن ذلک يحقق الديمقراطية والتقدم، فنحن بين دفتي رحى إحداها متشددة والأخرى منفتحة، بين تقريرٍ لضوابط قاسية أو لا ضوابط أو ضوابط متساهلة، وتناسوا طبيعة الشعب المصري وأخلاقه وعاداته وديانته، کل ذلک جعل من دراسة موضوع حرية الرأي والفکر أهمية بالغة وذلک في محاولة لبيان وتفصيل هذا الموضوع بشکل يؤدي إلى الحد من الاعتداءات الصارخة على حرية الآخرين أو على المجتمع في مبادئه وأخلاقه.

Abstract:
The importance of the exercise of this right is one of the most important rights affecting the life of the individual and the society because of its great influence on the emergence of ideas and the exchange of information and the fight against corruption, which leads to the prosperity of civilizations and their advancement, This is what made countries compete (either voluntarily or forcibly) to pay attention to it by organizing it and defining its framework and controls. The right is not absolute, but it is restricted by non-aggression against the constants of society, so that this right does not become a means of demolition for man and society.
The issue of freedom of thought and opinion is one of the most controversial issues. We find thinkers who are hard-line in their report, and others who adopt a broad (Western) concept of this right, believing that it achieves democracy and progress. We are between one extreme and the other open. And the nature of the Egyptian people, their ethics, their customs and their religion. All this made the study of the subject of freedom of opinion and thought very important in an attempt to explain and elaborate this issue in a way that would reduce the flagrant attacks on the freedom of others or the society in its principles and morals.
