النظام القانوني لرهن العلامة التجارية

ملخص :
رغم أن العلامة التجارية منقول لا عقار وتعبر عن حق مالي هو الحق الأدبي إلا أن رهنها يمتاز بشيء من الخصوصية عن رهن باقي المنقولات ، فهي منقول معنوي عصي على الحيازة ، لذلک يأتي رهنها من خلال تسجيلها في سجل خاص بالرهون الواقعة عليها ، وقد استحدث المشرع الأردني شکلا جديدا من أشکال رهن المنقول ينطبق هو الآخر على رهن العلامة التجارية ألا وهو الرهن من خلال الإشهار في سجل خاص رهنا مجردا من شرط انتقال الحيازة .
وجاء هذا البحث في ثلاثة مباحث تناولنا في الأول منهما ماهية رهن العلامة التجارية من خلال تناول تعريف هذا الرهن ومن ثم بيان شروطه القانونية ، وفي المبحث الثاني تناولنا الطبيعة القانونية لرهن العلامة التجارية وفي المبحث الثالث تناولنا التزامات الراهن في هذا النوع من الرهن، وقد خلصنا بالنتيجة لجملة من النتائج والتوصيات أوردناها في هذا البحث.

Abstract:
Although the trademark is transferred not real estate and expresses a financial right that is literary right, its mortgage is characterized by a degree of privacy from the mortgage of the rest of the movables.
They are transferred morally, impossibility of possession, so their mortgage comes through their registration in a special register of mortgages against them. And the Jordanian legislator has introduced a new form of movable mortgage that is also applicable to the mortgage of the trademark, which is mortgage through publicity in a special register subject to the transfer of possession. And this research came in three sections that dealt with in the first of which is the mortgage of the trademark by defining this mortgage and then clarifying its legal conditions ، In the second topic, we dealt with the legal nature of the mortgage of the trademark, and in the third topic we examined the obligations of the present in this type of mortgage, and we have concluded the result for a set of results and recommendations that we have mentioned in this research.
