ملخص البحث :
تناول هذا البحث موضوع الکرامة الإنسانية في التصور الإسلامي وتطبيقاتها الفقهية ، دراسة مقارنة ، وهو محاولة مبدئية لسد الفجوة التي نعيشها نحن المسلمين على المستوي الأکاديمي وغيره ، إذ يظل الطالب – في غالب الأحيان - يعيش انفصاما واضحا فيما يخص الکرامة الإنسانية إذ يدرس تکريم الإسلام للإنسان ومظاهر ذلک دون أن يدلف إلي عالم التطبيقات الفقهية التي تضج بالأمثلة التي تند عن الحصر والتي تتجذر فيها الکرامة الإنسانية بکل تجلياتها .
 وقد تمثل هذا التناول في جانبين : الأول : التصور الإسلامي للکرامة الإنسانية من حيث الماهية، والخصائص، والمظاهر ، وذلک من خلال ما جاء من کثير من الآيات القرآنية الکريمة  والأحاديث النبوية الشريفة . والثاني : بعض التطبيقات الفقهية التي تجسد فيها التصور الإسلامي للکرامة الإنسانية ، حيث لعب هذا التصور دورا مهما في المأمورات والمنهيات التي جاءت جميعها حافظة للکرامة الإنسانية وحامية لها من جميع الآفات والأضرار . وقد انتهى البحث إلى مجموعة من النتائج أهمها : أن الکرامة الإنسانية في التصور الإسلامي  قيمة عليا خص الله سبحانه وتعالى بها الإنسان ، ومعناها أن يکون للفرد قيمة ، وأن يحترم لذاته ، وأن يعامل بطريقة أخلاقية ، وأن تحفظ کرامته فلا ينال منها حيا وميتا بأي شکل من الأشکال . وأن أصول الشريعة الإسلامية، وقواعدها، ومقاصدها جميعها تحفظ کرامة الإنسان، وتصون حقوقه کاملة غير منقوصة . وأن التصور الإسلامي للکرامة الإنسانية جاء سابقا لکل القوانين والمواثيق والاتفاقيات الدولية ، کما جاء متفوقا على کل هذه القوانين والمواثيق والاتفاقيات حيث جمع بين التنظير والتطبيق في جميع جزئياته ، فلم يبق التصور الإسلامي للکرامة الإنسانية رؤى نظرية أو معرفة ذهنية فحسب ، بل کان واقعا معيشا ، وتطبيقا عمليا في کافة  جزئيات التشريع الإسلامي فلا  تجد حکما واحدا يسلب هذه الکرامة أو ينتقص منها ، في حين تعانى هذه التشريعات والمواثيق المختلفة من الانفصام والازدواجية بين التنظير والتطبيق .

Human dignity in the Islamic perception And its Jurisprudence Applications - A Comparative Study

Abstract:
This research dealt with the topic of human dignity in Islamic perception and its jurisprudential applications, a comparative study. It is an initial attempt to bridge the gap that we Muslims live at the academic level and others, as the student continues - in most cases - to live a clear separation with regard to human dignity as he studies the honor of Islam for man and the manifestations of this without drawing into the world of doctrinal applications that abound with examples that are based on the inventory. And in which human dignity is rooted in all its manifestations.
This approach has been represented in two aspects: The first: Islamic perception of human dignity in terms of essence, characteristics, and appearances, through what came from many of the noble Qur’anic verses and noble hadiths. The second: Some doctrinal applications that embody the Islamic perception of human dignity, where this perception played an important role in the matters and prohibitions that all came to preserve human dignity and protect it from all pests and damages. The research ended with a set of results, the most important of which are: human dignity in the Islamic perception is a supreme value that God Almighty singled out for man, and its meaning is that the individual has value, that he respects himself, be treated in an ethical manner, and that his dignity is preserved so that he is not attained alive and dead in any form of Shapes. And that the principles of Islamic Sharia, its rules, and its purposes all preserve the dignity of the human being, and safeguard his full and undiminished rights. And that the Islamic perception of human dignity came earlier to all laws, charters and international agreements, as it came above all these laws, charters and agreements, as it combined theory and application in all its parts, Not only did the Islamic perception of human dignity remain theoretical visions or mental knowledge, but it was a living reality, and a practical application in all parts of Islamic legislation, you do not find a single rule that deprives this dignity or detracts from it, while these various legislations and agreements suffer from the separation and duplication between theory and application.
