قواعد الضمان في الفقه الإسلامي

الملخص:
إن قواعد الضمان لها أهمية کبيرة وأثر کبير في أحکام الفقه الإسلامي ، ويرى الباحث أنا لحاجة ماسة لإبراز هذه القواعد وتقريبها للقارئ باختصار، وقواعد الضمان تمس ما يقع من إتلاف في الأموال أو النفوس وما يترتب على ذلک، ويظهر البحث عدل الشريعة الإسلامية وحفظها للحقوق.
وقد سار البحث في مقدمة وتمهيد في التعريف بعلم القواعد الفقهية ،ثم تبع ذلک الفصل الأول وفيه بيان تعريف الضمان وأدلة مشروعيته والمقاصد الشرعية المتعلقة بالضمان، وأسباب الضمان، وتبعه الفصل الثاني وفيه بيان أرکان الضمان، ثم سرد للقواعد المتعلقة بالضمان وبيان معنى کل قاعدة وذکر مثال عليها.

Abstract:
 The rules of guarantee have a great importance and a significant impact on the provisions of Islamic jurisprudence, and the researcher believes that there is an urgent need to highlight these rules and bring them closer to the reader in a nutshell, and the rules of guarantee affect what is happening in the destruction of money or souls and the resulting consequences, and the research shows the justice of Islamic law and its preservation of rights. The research went on in the introduction and preamble in the definition of jurisprudence knowledge, then followed the first chapter and it includes a statement of the definition of security and its legitimacy guides and legitimate intentions related to the guarantee, and the reasons for guarantee, followed by the second chapter and a statement of the pillars of the guarantee, then listed the rules related to the security and clarify the meaning of each rule and mentioned an example  on her.
