ملخص البحث:
يتناول هذا البحث دراسة تطبيقية للائحة الذوق العام السعودية، والتي کان الهدف من صدورها، تعزيز احترام الذوق العام بين الناس، ووضع إطار قانوني محدد يلتزم به الکافة، حيث أقرت بعض العقوبات المالية، للحد من مظاهر الإساءة للذوق العام، والخروج عن الآداب العامة، وبعض السلوکيات التي تتنافى مع العادات والتقاليد السائدة في المجتمع، في الأماکن العامة، وتناول مدى مشروعية التجريم والعقاب في هذا الباب من الناحية المقاصدية والقانونية.
کما أنه يبرز دور المقاصد الشرعية، والنظام الجنائي، وکذلک العرف، والعادات في نشأة الذوق العام، وحمايته، کما استعرض التکييف النظامي لجريمة الذوق العام، وضوابط تطبيق عقوباتها.

Protecting public decency between legitimate intent and the criminal system
An applied study on the Saudi public taste list

Abstract:
This study deals empirically with the Saudi Public Decency Law, which   was issued to enhance the people's respect for public decency. The law also aimed to establish a specific legal framework to be adhered by all. The law established some financial sanctions to decrease the manifestations of violating public decency, deviation from public morals, and unacceptable behaviors according to prevalent custom and traditions of the society in public places. The study addresses the criminal and penal legalization of the law of public decency in terms of Maqassed (i.e. purposes) and law. The study also focuses on the role of Maqaṣid Al-Shariaa (purposes of Sharia), penal system, Urf (i.e. custom of the society) and conventions in the development of public decency and its protection. Furthermore, the study sheds light on the statutory conditioning of the crime of public decency, and the regulations of applying its sanctions.
