ملخص البحث :
    خلاف الأولى کحکم من الأحکام الشرعية التى نود أن ننيط اللثام عنها، قد اختلف الأصوليون في موقعه من الأحکام الشرعية، وإن تأکد لدى الجميع وجوده لا ريب، إذ لا يختلف اثنان أن ترک سنة مؤکدة مکروه من المکروهات، وليس هذا أمرا مستحبا، لکن درجة کراهته ليست کمن توضأ أربعا، أو مسح رأسه مرتين ! وإن اتفقا في جنس المکروه ، لذا عد بعض الأصوليين خلاف الأولى موقعا وسطا بين المکروه والمباح، وهو ما بينته في هذا البحث.
   وتعرضت في هذا البحث لتعريف خلاف الأولى، وتحقيق الکلام فيه، والفرق بين خلاف الأولى والمکروه، وکذلک الفرق بين خلاف الأولى والمباح، وأن خلاف الأولى داخل في الأحکام التکليفية. ثم بينت بعض الأحکام المتعلقة بخلاف الأولى کحکم من ارتکب خلاف الأولى، وصدور خلاف الاولى منه صلى الله عليه وسلم والرخصة بخلاف الأولى، ثم ذکرت بعض المسائل التطبيقية على خلاف الأولى من أبوب الفقه المختلفة.

Abstract :
        Other than the first as one of the Islamic rulings that we would like to hear about, the fundamentalists differed in its position of Islamic rulings, although it is certainly confirmed by everyone its existence, since it is no different for two to leave a certain year hated from the hated, and this is not desirable, but the degree of his hatred is not like the one who has clarified four, or wiped his head twice! If they agree on the sex of the hated, then some fundamentalists have counted the difference of the former as a middle ground between the hated and permissit, which is what i have shown in this research.
   In this research, i was exposed to the definition of the difference of the former, the realization of the speech in it, the difference between the difference between the first and the hated, as well as the difference between the difference of the former and the permissible, and that the difference of the former within the mandated provisions. It then indicated some of the provisions relating to the first as the one who committed the first dispute, and the issuance of a dispute of the first of which is the peace and the license other than the first, and then mentioned some of the applied issues unlike the first of the different jurisprudence.
