ملخص البحث :
تناولت هذه الدراسة ( أثر المستجدات الطبية على حق المرأة في الفرقة للعيوب التناسلية ) وهذا البحث يعد دراسة مستفيضة تهدف إلى الخروج بالحکم الشرعي وفق المعطيات الطبية بعد معرفة الحکم الفقهي السائد لها ، والمستجدات الطبية لها أثر کبير في کثير من الأحکام الفقهية ، ولکني تخيرت عيوب النکاح لما لها من أثر کبير في استقرار الحياة الزوجية ، أو اضطرابها ، فإذا وجد عيب ينغص هذه العلاقة  ، ويکدرها بحيث لا يتحقق الهدف من العقد ، فإن أکثر الفقهاء يعطون الحق للمتضرر في إنهاء العقد إن رغب في ذلک ، ومن أکثر العيوب التي تؤرق الحياة الزوجية ، وتهدد کيانها واستقرارها العيوب التناسلية ، سواء کانت عند الرجل ، أو المرأة ، وقد اقتصرت الدراسة على العيوب التناسلية عند الرجل ، وقد مثل لها الفقهاء بالجب ، والعنة ، والخصاء ، ولا تنحصر العيوب التناسلية فيها ، بل کل ما شارکها في العلة فهو عيب تناسلي يتيح للمرأة حق فسخ النکاح ، ولم تهمل الدراسة الإشارة إلي نماذج من العيوب التناسلية المعاصرة ، مبرزة موقف الفقه الإسلامي من التفريق بهذه العيوب التناسلية المعاصرة ، وقد أولت الدراسة الاهتمام ببيان أثر المستجدات الطبية على حق المرأة في التفريق بالعيوب التناسلية ، وذلک في مبحث مستقل قسمته إلى خمسة مطالب بينت فيها : أثر المستجدات ىالطبية على عيب الجب ، وأثرها على عيب الخصاء ، وأثرها على عيب العنة ، وأثرها على عيب الخنوثة ، وختاما أثرها على عيب العقم ، ثم خلصت الدراسة إلى أهم النتائج ، والتوصيات .

Abstract:
This study deals with (the impact of medical developments on the right of women in the band with reproductive defects) and this research is a comprehensive study that aims to come up with the legal ruling according to medical data after knowing the prevailing jurisprudential ruling for it, and medical developments have a great impact on many jurisprudential rulings, but I chose the defects of marriage Because of its great impact on the stability of marital life, or its turmoil If there is a defect that disturbs this relationship and upsets it in such a way that the goal of the contract is not achieved, most of the jurists give the right to the aggrieved party to terminate the contract if he so desires. The study was limited to the man’s reproductive defects, and the jurists represented her with obligatory, curse, and castration, and reproductive defects are not limited to it, rather everything that shares her in the illness is areproductive defect that allows women the right to annul the marriage The study did not neglect the reference to examples of contemporary reproductive defects, highlighting the position of Islamic jurisprudence on differentiating these contemporary reproductive defects, and the study paid attention to explaining the impact of medical developments on the right of women to differentiate with reproductive defects, in an independent study that divided it into five demands in which it was shown The effect of medical developments on the defect of the fetus, its effect on the castration defect, its effect on the defect of impotence, its effect on the defect of intersexuality, and finally its effect on the defect of sterility, then the study concluded with the most important results and recommendations.
