 ملخص :
تعتبر محددات مستلزمات العقد من الموضوعات التي يسهم فيها القضاء بعملية إکمال مستلزمات العقد، فهنا يثور التساؤل حول مصدر الالتزامات التي يضفيها القاضي إلى مضمون العقد الذي يشوبه النقص أو الغموض، لأن الأصل أن العقد هو شريعة المتعاقدين فلا يستطيع القاضي التدخل في إرادة المتعاقدين، فهل تعد مستلزمات العقد التي يضيفها القضاء هل تعتبر من ضمن إرادة المتعاقدين، أم أنها تعبير عن إرادة المشرع، هذه التساؤلات وغيرها کانت محط أنظار هذه الدراسة، فتم تقسيمها إلى أربعة مباحث تناولت دور أحکام القانون في تحديد مستلزمات العقد، وطبيعة الالتزام وعلاقته بمستلزمات العقد، ومبدأ العقد شريعة المتعاقدين وعلاقته بمستلزمات العقد، ومبدأ حسن النية في تنفيذ العقود وارتباطه الوثيق بمستلزمات العقد.

Abstract:
The contract requirements are considered to be a matter in which the court contributes to the completion of the contract requirements. This raises the question of the source of the obligations that the judge adds to the content of the contract, which is incomplete or ambiguous, because the original fact that the contract is the contract of contract is the contract of contract, and the judge cannot interfere with the contract's will. The first is that the government of the United States has not yet done so, and that it has not yet done so. The principle of the contract is the pacta sunt servanda and its relationship to the terms of the contract, the principle of good faith in the execution of the contracts and its close association with the terms of the contract.
