مقاصد الأبواب الفقهية في المؤلفات المعاصرة- دراسة استقرائية تحليلية

ملخص البحث:
کَثُرت المؤلفات المعاصرة التي تتناول المقاصد الشرعية، وتعددت، وتنوعت، وتفاوتت في دراسة المقاصد؛ وکان من أبرزها ما اتجه إلى دراسة المقاصد الشرعية في الأبواب الفقهية؛ فقد اهتم کثير من الباحثين المعاصرين بدراسة مقاصد الأبواب الفقهية المختلفة؛ فأفردوها بالتصنيف والدراسة، ونحا بعضهم منحى أخص، من خلال توجيه النظر والبحث إلى باب خاص من أبواب الفقه؛ فدُرِست مقاصد العبادات وصُنِّف فيها مصنفات خاصة، بل أُفردت مؤلفات في دراسة مقاصد الصلاة، وأخرى في مقاصد الزکاة، وکذا مقاصد الصيام، ومقاصد الحج، وغيرها من العبادات، وکذلک الحال في بقية الأبواب الفقهية؛ حيث دُرِست مقاصد الشريعة في باب  المعاملات، وفي أحکام الأسرة، وفي باب العقوبات، وغيرها.
ولم تسلک الدراسات والمصنفات المعاصرة في دراسة مقاصد الشريعة في الأبواب الفقهية مسلکاً واحداً؛ فالمتأمل لها يلحظ تفاوتاً ظاهراً في معالجة المقاصد الشرعية في تلک الأبواب؛ حيث نجد أن بعضها يکتفي ببيان المقصد الشرعي في کل حکم شرعي جزئي داخل في ذلک الموضوع، بينما يقتصر بعضها على بيان المقاصد العامة لهذا الباب الفقهي، دون التعرض لمقاصد الأحکام الجزئية الداخلة في هذا الباب، کما أن بعضها يقتصر على التعليل المختصر، وبعضها يطيل ويغوص في بيان المقاصد الشرعية وإظهارها، ويبسط الحديث في ذلک.
کما تفاوتت المؤلفات المعاصرة من حيث شمولها ومعالجتها لمسائل أبواب العبادات والمعاملات والعقوبات وأحکام الأسرة؛ فمنها ما کان شاملاً لدراسة غالب مسائل الباب، ومنها ما اختص بدراسة مقاصد بعض مسائله.
ولذا جاء هذا البحث بهدف کشف مسارات التأليف في هذا الاتجاه عند المعاصرين، مع ذکر أبرز المصنفات في کل مسار، والتعريف بها، وترتيبها، وتصنيفها، وجمعها في سلک واحد؛ حتى يتمکن طلاب العلم من الإفادة منها في ضبط فروع الشريعة ومسائلها من خلال الالتفات إلى مآخذها وأسرارها.

Fiqh ‏Objectives Chapter in Contemporary Literature – An inductive analytical study

‏Contemporary literature dealing with legal objectives has been varied in the study of objectives. Among the most prominent was the study of the legal objectives in the Figh chapters. Many contemporary researchers have been interested in studying the objectives of the various fiqh chapters by  classification and study, and some took a more specific approach by directing consideration and research to a special section of Figh. The objectives of the acts of worship were studied and special compilations were compiled in them. In fact, books were only study the purposes of prayer, and others the purposes of zakat, as well as the purposes of fasting, the aims of Hajj, and other acts of worship, as is the case in the rest of the chapters of Figh. Where the objectives of Sharia were studied in the chapter on transactions, and family affairs , as well the chapter on penalties, and others.
‏Contemporary studies and compilations have not followed a single approach in the study purposes of Sharia in the Figh chapters. They apparent difference approaces in dealing with legal objectives in those chapters. Whereas we find that some of them are satisfied with stating the legal intent in every partial legal ruling within that topic, while some of them are limited to explaining the general intentions of this Figh section, without addressing the intentions of the partial rulings included in this section, and some of them are limited to a brief explanation, and some of them lengthen and elaborateed of explaining and demonstrating the legitimate aims, and the conversation is simplified in that.
‏Contemporary literature also varied in terms of its comprehensiveness and treatment of issues related to the chapters of worship, financial , penalties and family affairs. Some of them were comprehensive to study most of the issues of the section, and some were concerned with studying the purposes of some of its issues.
‏Therefore, this research came with the aim of uncovering the paths of authorship in this direction among the contemporaries, with mentioning the most prominent works in each path, identifying them, arranging them, classifying them, and collecting them . So that students of knowledge can benefit from it in controlling the branches and issues of Sharia by concentrating in its sockets and secrets.
