ملخص البحث:
لما کانت نصوص الوحيين متنوعةٌ في بيان ما کلّفنا الله به - على ما قرره لسان القرآن الکريم- بين الإنشاء کالأمر، والنهي، والدعاء، أو الخبر إن کان المقصد ثمَّ نسبة شيء لشيء، وأن صيغ الطلب سواء کانت طلبًا للفعل، أو طلبًا للترک، أو کانت جازمة، أم غير جازمة، مغايرة في الحقيقة لماهية الخبر، من حيث إن "الخبر دالٌّ -من قبل- على حصول أمر في الخارج، فإن کان مطابقًا له فهو الصدق، وإلا فهو الکذب، وهذا يخالف الإنشاء من وجوه.
وحصر البحث صيغ التکاليف الشرعية الحقيقية والمجازية، ومنها الخبرية، وکشف أن المعنى الحاصل بإيراد الطلب الشرعي بالجملة الخبرية وإن کان وقع بأسلوب مجازي؛ إلا أن الشارع أراد المبالغة في وجوب المأمور به، فالعدول إلي الجملة الخبرية؛ لأن المخبرَ به إن لم يوجد في الخبر فقد يلزم بذلک کذب الشارع، أما إذا لم يوجد المأمور به في الأمر فلا يلزم ذلک.
والبحث يبرز استثمار الصيغ الخبرية، والقصص، والأمثال الشرعية؛ لاشتمال هذه الصيغ على علم کثير، وأحکام وتشريعات، کما تشتمل على خلاصات وتجارب، وخبرات ما حصل للأمم السابقين، وسنن الله التي لا تتخلف ولا تتبدل وإن جاءت على غير ما عهد في آيات الأحکام والتشريع من أساليب.
وأبرز البحث أن الأمثال القرآنيَّة، والقصص مما يجب على المجتهد معرفته، وهو مؤهل من مؤهّلات المجتهد مما يجب معرفته، حتى جعل الشافعي الأمثال جزءاً مما يجب على المجتهد معرفته، فلم تغب قضية البحث عن المفسرين، والبلاغيين، وشرّاح السنن، ولکن أبرز البحث جهود کل طائفة من العلماء.
وبين البحث کيف طور الأصوليون هذه المسألة وأبرزوها في مؤلفات مستقلة، حتى اتفق الکل أن قصص القرآن وأمثاله ليست مجرد آيات للتلاوة، أو قصصًا للإنذار، أو أخبار عما سلف من الأمم في حياتهم وهلاکهم، أو مادة للإعجاز للغوي فقط، أو مجرد رقى يسترقى بها المرضى، أو تقرأ على الموتى دون أن يکون لها موضع الأصل والصدارة في صياغة أفعال العباد والحکم عليها.
والبحث يعدّ تطبيقًا لنظرية الوحدة البنائيّة التي تعني: أن کل کلمة، وکل آية، وکل سورة، يعتبر کأنه جملة واحدة، بحيث لا يقبل بناؤه وإحکام آياته التعدّد فيه، أو التجزئة في  أن يقبل بعضه ويرفض بعضه الآخر، کما لا يقبل التناقض أو التعارض وغيرهما من عيوب الکلام، وأن الاستفادة الحاصلة بهدي القرآن تکون به کلّه.
وتعرض البحث إلى شرع من قبلنا إلينا فيما ورد في القرآن الکريم أو السنة النبوية المشرفة ولم ينقل معها نسخ له، ولم ينقل معها أنها مشروعة في حقنا، أم لا، فهو شرع لنا أي: «حجة»، وهذا قول کثير من الشافعية, والحنفية, وطائفة من المتکلمين, وأنه أصل يتخرج عليه فروع کثيرة.

The significance of  the declarative forms on the legal rules and its  impact on the jurisprudential branches

Abstract:
It is a fact that the sacred Islamic texts represented in Qur'an and Sunnah are diversified into informing and reporting statements. The informing statement, on the one hand, includes asking questions, giving commands or using the vocative case. The reporting statement, on the other hand, is constructed when something is added to another to produce a useful meaning.  The informing clauses, whether they are imperative or prohibitive or emphatic or unemphatic, are different from the reporting ones as the latter provides information that has the potential of being either true or false. In other words, the information provided can be verified or falsified in its own content. If the information conveyed to the addressee is correct, i.e. corresponds to the circumstances and the context of the situation in reality, the reporting proposition is deemed to be true; if it is incorrect, the proposition is deemed false.
The present study enumerates the real literal and figurative expressions used in Qur'an and Sunnah to indicated the Sharī'ah obligations, including the reporting expressions. It finds that applying the informing clauses, even figuratively, in the context of Sharī'ah obligations conveys emphasis that obligation.
Moreover, the study highlights the importance of applying the reporting figures, and utilizing the narratives and similitudes as they include knowledge, rulings and legislations in abundance. They also include synopses of what the ancient and previous nations had experienced which confirm that Allah’s established method and enactment do not change or diverted.
In addition, the study spots light on the importance of Qur’anic similitudes and narratives considering them one of the qualifications that Mujtahid must master and get acquainted with, as Imam al-Shāfi’i maintained.
The Study clarifies how the scholars of Usul al-Fiqh (the fundamentals and principles of jurisprudence) developed and elaborated on this issue and singled it out in treaties and books until it is unanimously agreed that the Qur'ānic narratives and similitudes have not been quoted for mere recitation or storytelling, they are rather meant to formulate the right course of actions for all people.
The present study is considered an application of the theory of structural unity which means that every single word, verse and chapter of the Qur'an serve as one sentence and must be taken as one, undivided unity with no contradiction nor discrepancy therein and thus it fruits benefits.
The study also investigates the legislations of the previous nations mentioned in the Qur'an or the Sunnah which have not being abrogated nor reportedly and confirmed as accepted or rejected. Such legislations are bound to us as many scholars of Shafi'iah and Hanafiah and many theologians confirmed.
