ملخص البحث:
الحمد لله وحده والصلاة والسلام على من لا نبي بعده..... وبعد.
فإن المرأة کائن حي مکرم، بل ومکلف من قبل رب الأرض والسماء، ومؤثر في کل نواحي الحياة، فلها مکانتها التي تجعلها وبکل قوة تستطيع القيام بدورها الإيجابي الفعال في کل موقع من مواقع المسئولية في الحياة عبر الزمان والمکان، بعيدا عن النظرة المقلدة للغرب، مستمدة لتلک الإيجابية القوية من منبع الإسلام ومصادره الموثوقة، فلقد شارکت المرأة في الدعوة إلى الله - عز وجل -  وفي البيعتين، وفي الشورى، وفي الهجرتين، وفي کثير من الغزوات والمعارک المختلفة مع رسول الله - صلى الله عليه وسلم- والصحابة - عليهم رضوان الله -والخلفاء الراشدين من بعده، بل وإلى يومنا هذا، بل وکانت المرأة محاورة في شتى المجالات، الأمر الذي جعلني أفکر بالمشارکة في إظهار الصورة الصحيحة للمرأة من حيث حقوقها وواجباتها، وما يجوز لها أن تقوم به في ممارسة تلک الحقوق والتي منها: حقها في رئاسة الدولة، فقويت رغبتي - بفضل الله تعالى- في المشارکة في بحث هذا الموضوع المعاصر:(المرأة ورئاسة الدولة بين الفقه الإسلامي والواقع المعاصر- دراسة فقهية واقعية معاصرة)، وعزمت بحول الله - عز وجل - وقوته على دراسته ، وقد اقتضت مشيئة الله - تعالى- فيه أن يشتمل على مقدمة وفصلين وخاتمة .
سائلا المولى - العلي القدير- التوفيق والسداد، والوصول إلى ما فيه الخير والرشاد، إنه ولي ذلک  والقادر عليه، وآخر دعوانا أن الحمد لله رب العالمين وصلي اللهم على  سيدنا ونبينا محمد  وعلى آله وصحبه وسلم.

Abstract:
Praise be to God alone and prayers and peace be upon the one who has no prophet after him ..... and after.
For a woman is an honorable living being, and even mandated by the Lord of the Earth and Heaven, and influential in all aspects of life. She has her position that makes her, with all strength, able to play her active positive role in every position of responsibility in life, away from the imitating view of the West, deriving from that strong positive From the source of Islam and its reliable sources, the woman participated in the call to God - the Almighty - and in the two sales, in the Shura, in the two emigration, and in many different invasions and battles with the Messenger of God - may God bless him and grant him peace - and the rightly guided caliphs after him, and even to this day. Indeed, the woman was an interlocutor in various fields, which made me think about participating in showing the right image of the woman in terms of her rights and duties, and what she may do in exercising those rights, including: her right to head the state, and my desire to participate in researching this The Contemporary Issue: (Women and the Head of State between Islamic Jurisprudence and Contemporary Reality - Contemporary Realistic Jurisprudence Study), I have decided about God - the Almighty - and his power to study this subject, which required the will of God - the Almighty - in it to include an introduction, two chapters, and a conclusion.
He asked the Lord, the Most High, the Almighty, the success and the payment, and the attainment of what is good and guidance.
