مسائل أبي زرعة الدمشقي الفقهية للإمام أحمد -جمعاً ودراسة-

ملخص البحث :
يتناول هذا البحث المسائل الفقهية للإمام أحمد بن حنبل –- رحمه الله - - التي رواها عنه تلميذه وصاحبه أبو زرعة الدمشقي الإمام المحدث المشهور، ودراستها دراسة فقهية مقارنة بما استقر عليه المذهب عند السادة الحنابلة، وقد جاء في مقدمة فيها أهمية البحث، ومنهجه، وإجراءاته، والدراسات السابقة، وخطة البحث، وتمهيد فيه ترجمة للإمام أبي زرعة الدمشقي، ولم أترجم للإمام أحمد اکتفاءً بشهرته.
وثمانية مطالب فيها المسائل الفقهية: المطلب الأول: حکم المضمضة والاستنشاق في الوضوء والغسل، وهل تعاد الصلاة عند ترکهما؟، والمطلب الثاني: هل البسملة آية من الفاتحة؟، والمطلب الثالث: حکم صلاة من ترک الصّلاة على النبي - r - ، والمطلب الرابع: حکم الحجامة للصائم،و المطلب الخامس: حکم صيام المرأة للنذر من غير إذن زوجها، والمطلب السابع: هل يثبت للجار حق الشُّفعة؟، المطلب الثامن: ختان من أسلم وهو کبير.
وأما الخاتمة: فقد اشتملت على أهم النتائج، ومنها: أن الإمام أبو زرعة الدمشقي من العلماء الحفاظ، وقد نقل عن الإمام أحمد مسائل عديدة في العقائد، والحديث، والفقه وغيرها، وأن عدد المسائل الفقهية التي رواها أبو زرعة عن الإمام أحمد - رحمه الله - حسبما وقفت عليه ثمان مسائل، ست مسائل منها صارت هي المعتمدة في المذهب، واثنتان منها استقر المذهب على خلافهما.
ومن التوصيات: الاهتمام بمسائل الإمام أحمد- رحمه الله - ففيها علم جم غزير ويمتزج فيها الحديث بالفقه.

Issues of Abu Zar'ah al- Dimashqi jurisprudence by Imam Ahmad - collection and study -

Abstract:
This research deals with the jurisprudential issues of Imam Ahmad bin Hanbal - - may God have mercy on him - - that his student and companion Abu Zar'ah al-Dimashqi narrated about him, the well-known modern Imam, and studied them as a jurisprudential study compared to what the doctrine has settled upon according to the Hanbalis. And previous studies, research plan, and a preface in it with a translation of Imam Abu Zar'ah al-Dimashqi, and I did not translate Imam Ahmad, however, his fame was satisfied.
And eight demands on matters of jurisprudence: The first requirement: the rule of rinsing the mouth and nose in ablution and washing, and will prayer be repeated when leaving them ?, The second requirement: Is basmalah a verse from al-Fatiha ?, and the third requirement: the rule of prayer for the one who neglects prayer on the Prophet -r- And the fourth requirement: the rule of cupping for the fasting person, and the fifth: the rule of a woman’s fasting for a vow without her husband’s permission, and the seventh requirement: Does the right of intercession prove to the neighbor ?, The eighth requirement: circumcision of a Muslim who is older
As for the conclusion: it included the most important results, including: Imam Abu Zar'ah al-Dimashqi is one of the scholars of preservation, and Imam Ahmad quoted many issues regarding beliefs, hadith, jurisprudence and so on, and that the number of jurisprudential issues that Abu Zar'ah narrated on the authority of Imam Ahmad - may God have mercy on him - According to what eight issues were concerned with, six of them became the ones adopted in the doctrine, and two of them were settled by the doctrine in contrast to them.
Among the recommendations: Paying attention to the issues of Imam Ahmad - may God have mercy on him - in which there is great knowledge and mixing hadith with jurisprudence.
