القوامة في الأسرة بين التعليل والتقصيد

تعد القوامة في الأسرة من أهم المفاهيم المنظمة للحياة الأسرية، والسائرة بها نحو تحقيق السکن والمودة والرحمة، وقد وردت معللة في کتاب الله تبارک وتعالى، إلا أن علتها لم تتحرر من حيث النوع، ولم يستبن کون القوامة مقصداً أو وسيلة لتحقيق مقصد. يأتي البحث ليوضح علة القوامة المرکبة، ويبين جزئيها، ويتناول تقصيدها تحت مظلة مقاصد النکاح الأصلية، إضافة إلى بيان مقتضياتها في حق القوّام ومن يقوم عليهم، وبيان مواقف الفقهاء عند تخلف جزء من أجزاء العلة، أو عند تقاعد القوامة عن تحقيق مقاصدها . وقد توصل البحث إلى عدة نتائج، من أهمها: أن القوامة هي سلطة تنظيمية لشؤون الأسرة قائمة على الشورى. وأن علة القوامة مرکبة من جزءين : القوة البدنية والعقلية من جهة، والإنفاق بالمال من جهة أخرى. أن القوامة من الأحکام المقصودة لغيرها، فهي من علم الوسائل لا المقاصد. أن القوامة خاضعة للتفويض والتفاوض، ويمکن للرجل تفويض إدارة المنزل کاملاً إلى الزوجة. تکون القوامة على الزوجة وعلى سائر أفراد الأسرة من البنات والبنين غير البالغين. تقصيد القوامة يبرز قيامها على الاستقرار واکتمال معاني المودة والرحمة والتعامل الوظيفي.

Abstract
Guardianship in the family is one of the most important organizing concepts of family life, which is moving towards achieving (tranquility, affection and mercy). It was mentioned as reasoning in the Book of God, the Blessed and Exalted be He. . The research comes to clarify, the problem of the compounded guardianship, clarify its two parts, and address its purpose under the umbrella of the original intentions of marriage, in addition to, explaining its requirements regarding the right of the Qiyamah, and those who are based on them, and clarifying the positions of the jurists, when a part of the parts of the problem is left behind, or when the retirement of the guardianship, from The fulfillment of its purposes. The research has reached several results, the most important of which are: The guardianship is an organizational authority for family affairs, based on shura. The problem of stewardship has two parts: physical and mental strength on the one hand, and spending with money on the other. Guardianship is one of the rulings intended for others, as it is a science of means, not intentions. The guardianship is subject to delegation and negotiation, and the man can fully delegate the management of the house to the wife. The custody of the wife and the rest of the family members, girls and boys, who are not adults. The intransigence of the guardianship, highlights its basis on stability, and the completeness of the meanings of affection and compassion, and functional interaction.
