ملخص :
استقر القضاء الإداري السعودي على الأخذ بنظرية المسؤولية دون خطأ وذلک کأساس تکميلي للمسؤولية الإدارية في بعض الفروض، وذلک بجانب الخطأ کأساس عام لها.
وقد بنى مسؤولية الإدارة بدون خطأ على تأصيل شرعي أساسه حديث الرسول صلى الله عليه وسلم ( لا ضرر ولا ضرار )، کما تأثر القضاء الاداري السعودي في تأسيه لهذه المسؤولية بنظيره الفرنسي وذلک ببنائها أيضاً على أساس المخاطر ومبدأ المساواة بين الأفراد أمام الأعباء العامة،
کما صدرت في المملکة العربية السعودية بعض الأنظمة التي تحمل في طياتها تطبيقاً لمسؤولية الإدارة بدون خطأ حيث ساهم المنظم السعودي في تطوير المسئولية دون خطأ في مجالات عديدة، بابتکار حالات معينة تقوم فيها تلک المسئولية.

Abstract:
The Saudi administrative judiciary has decided to adopt the theory of responsibility without fault as a complementary basis for administrative responsibility in some assumptions, in addition to fault as a general basis for it
And he built the responsibility of the administration without fault on a legitimate basis based on the hadith of the Messenger, may God bless him and grant him peace, (No harm or harm), and the Saudi administrative judiciary was affected by establishing this responsibility with its French counterpart by building it also on the basis of risks and the principle of equality between individuals before public burdens,
Also, some regulations were issued in the Kingdom of Saudi Arabia that carry with it the application of the responsibility of the administration without fault, as the Saudi regulator contributed to the development of responsibility without fault in many areas, by creating specific cases in which that responsibility is carried out.
