ملخص البحث:
تناول الباحث قاعدة: الحرام لا يحرم الحلال، من جهة التأصيل؛ فبيَّن من قال بها من الفقهاء، وعلاقتها بالقواعد الفقهية، مع دراسة مستند هذه القاعدة والاعتراضات الواردة عليها، والجواب عليها، ثم تناول الباحث هذه القاعدة من جهة التطبيق، فذکر مسائل فقهية منثورة في کتب الفقه، اتخذت هذه القاعدة کمستند للقول بها، وناقش ذلک في ضوء أقوال علماء المذاهب الأربعة، وخلص الباحث إلى جملة من النتائج ختم بها بحثه، ثم شفعها بشيء من التوصيات، والله ولي التوفيق.

Abstract:
The researcher discussed a rule: the forbidden is not forbidden for the permissible, in terms of rooting He clarified those of the jurists who said about it and its relationship with the rules of jurisprudence, while studying the document of this rule and the objections contained therein, and the answer to it, then the researcher dealt with this rule from the point of application, and he mentioned doctrinal issues published in the books of jurisprudence, this rule was taken as a basis for saying it, and he discussed that in In light of the sayings of the scholars of the four schools of thought, and the researcher concluded with a set of results with which he concluded his research, then interceded with some recommendations, and God is the Grantor of success.
