ملخص البحث :
يتناول هذا البحث موضوع ضمان جودة المنتج في بيوع السيارات وأثره -دراسه فقهية قضائية - حيث قامت وزارة التجارة والاستثمار في المملکة العربية السعودية بتقديم لائحة وسياسة تحدد التزامات وکلاء السيارات تجاه المستهلکين تتضمن تحقيق السلعة لأغراضها ، مع ضمان جودة المنتج في وسائل النقل الحديثة ، وخلوها من العيوب .
ويشتمل البحث على مقدمة وأربعة مباحث ، وخاتمة تتضمن أهم النتائج ، ومنها :-
إذا ظهر العيب في السيارة بعد الشراء بالاستعمال ، وکان هذا العيب ليس مؤثرًا ولا جوهريا وکان هذا العيب يرجع إلى سبب قائم عند الوکيل فإن الوکيل مطالب بإصلاح العيوب.
وأما إذا کان العيب مؤثرًا وجوهريا کقيام الوکيل بيع سيارة تفتقد لشروط السلامة والأمان ولا يمکن تدارک إصلاحه فللمشتري الحق في فسخ البيع .
وأما إذا أهمل المشتري فحص سيارته أو ترک تغيير زيت المحرک حتى أدى إلى خلل في المکينة فيعد فعله مسقطا لحقه في الضمان .

Abstract:
This research examines the rule of virtue related to the worship first of related to its place or time; whereas the researcher examined the extended concept of the virtue meaning that is a synonym for recommended deed, Sunnah, recommendable, and what is not deemed a pillar or requirement.
This research plan includes an introduction, two topics, and a conclusion that includes the most significant results as follows: the origin requires to do worship including virtues and integrity, but if the man can not combine between the same cult and what is related to its place, he shall consider to give priority to the essence of the worship, for example, if the injector fears to miss Salah al Jama'ah if he reperform ablution at the beginning of the prayer time, then the priority shall be given to Salah al Jama'ah and eliminate supervening event. 
It is an exception to the general rule that there is a text determined the excluded one from the standard rule or the existence of an interest or need prevented to include the excluded question to the standard rule.
