ملخص البحث :
يعد مطلع القرن الثاني بداية فعلية لتشکل العلماء والفقهاء على شکل مدارس متنوعة، ومنتشرة في شتى الأقاليم الإسلامية، لکل منها في التعامل مع قضايا الفقه والأحکام والتشريعات المستحدثة منهج مستقل، ورؤية تختلف عن الأخرى.وعلى الرغم من تعدد المدارس الفقهية التي نشأت آنذاک فإن الفقهاء في العراق سواء في الکوفة أو البصرة، والفقهاء في الحجاز سواء في مکة أو المدينة کانوا أکثر تميزا وبروزا من غيرهم حتى خُص فقهاء العراق باسم أهل الرأي، وفقهاء الحجاز باسم أهل الحديث. وفي بداية القرن الثاني ازدادت حدة التنافس بين المدرستين، وصار کل فريق منهما أشد تمسکا بشيوخهم وأکثر انتماء لهم، ووصل هذا التنافس في فترة من الفترات إلى حد توجيه التهم والتقليل من شأن الآخر في موضوعات تتعلق بالرأي والحديث. فقد نقل عن الإمام مالک أنه يقول عن أهل العراق: أنزلوهم منزلة أهل الکتاب لا تصدقوهم ولا تکذبوهم، وقولوا: آمنا بالذي أنزل إلينا وأنزل إليکم.
وکان الرأي والحديث هو فيصل التفرقة وجوهر الخلاف بين کلتا المدرستين.فما موقف العلماء المعاصرين من صحة إطلاق أهل الرأي على فقهاء العراق وإطلاق أهل الحديث على فقهاء الحجاز ؟ و هل الأخذ بالرأي والاعتماد عليه کان متفاوتا بشکل کبير بين فقهاء العراق والحجاز؟وهل بضاعة فقهاء العراق في الحديث ضعيفة ولا ترقى إلى الاعتماد عليها وعلى تصحيحاتهم؟
وللإجابة على تلک الأسئلة اقتضى الحال أن تَبْحَثَ الدراسة في اتجاهات العلماء في تقسيم فقهاء القرن الثاني والثالث الهجري إلى أهل حديث وأهل رأي، وتتبع الأسباب التي انطلق منها کل اتجاه، من خلال النظر فيما قاله الفقهاء المعاصرون في دراساتهم الفقهية وما دونوه في مداخل العلوم الشرعية، ومن خلال دراسة مناهج العلماء وطبقاتهم في القرون الثلاث الأول.
 
 
وتوصلت الدراسة إلى : أن کلاً من فقهاء العراق وفقهاء الحجاز لديه حصيلة متقاربة من الحديث، سواء في الشيوخ أو في العدد، وساعد على هذا التقارب: الرحلات العلمية واللقاءات المستمرة، وخصوصا في مکة المکرمة. إنَّ المدرستين الفقهيتين يستعملان الرأي بدرجة متقاربة، وصور متشابهة، وقد برز في کل منهما من اشتهر بالرأي وأکثر منه.

Opinion and Hadith between the Jurisprudence schools of Hijaz and Iraq in the second and third century AH, an objective study

Abstract:
The early second century Hijri is viewed as the era that saw the categorization of scholars and jurists into various schools of thought which spread across various Islamic regions. Each of these schools had an independent approach and a vision that differed from the other in dealing with issues of jurisprudence, rulings, and new legislations. Despite the multiplicity of schools of jurisprudence that arose at that time, the jurists in Iraq (in Kufa or Basra) and the jurists in the Hijaz (in Makkah or Madinah) were more distinguished and prominent than others, to the extent where Iraqi jurists were singled out in the name of the ‘People of Opinion”, and the jurists of Hijaz in the name of the “People of Hadith”. The rivalry between the two schools intensified, and each group became more attached and affiliated to their sheikhs. This competition reached to the point of accusations and belittling of one another in matters related to Opinion and Hadith. It was reported that Imam Malik said about the people of Iraq “Give them the status of the People of the Book; do not believe them, do not deny them, and say we believed in what was revealed to us and revealed to you.”
The opinion and the hadith were the distinction and the essence of the disagreement between the two schools. So, what is the position of contemporary scholars regarding the validity of using the terms “People of Opinion” on the jurists of Iraq and the “People of Hadith” on the scholars of the Hijaz? And did the introduction and reliance on Opinion differ greatly
 
between the jurists of Iraq and the Hijaz? Is the scope of knowledge of the Iraqi jurists in Hadith that weak, and cannot be relied on?
To answer these questions, it was necessary for the study to explore the trends scholars used in categorizing the jurists of the second and third centuries Hijri into scholars of Hadith and Opinion; and to trace the reasons from which each trend evolved, by looking at what contemporary jurists said in their jurisprudence studies and what they wrote in the introductions to Sharia sciences, and by studying the scholars' curricula and their classification in the first three centuries.
The study found that both the scholars and jurists of Iraq and the Hijaz are at par with regards to Hadith— whether in the number of Hadith reported or the Sheikhs they reported from. This parity was due to frequent study trips and continuous meetings with scholars, especially in Makkah Al-Mukarramah. The two schools of jurisprudence use opinion in a close manner and similar forms, and it is evident in each of the schools what had emerged from opinion and more.
