ملخص البحث :
تم دراسة حُرْمة الحياة الخاصة من منظور القوانين العقابية، دراسة مقارنة بين عدة تشريعات، وتبين من الدراسة أنها تختلف من منظور القوانين العقابية عنها من منظور فروع القانون الأخرى؛ حيث قد يوجد من منظور هذه الأخيرة أفعالاً تشکل إعتداء على الخصوصية، ولکنها لا تخضع لنص تجريم الإعتداء على الخصوصية. لم تعد القوانين العقابية تقصر حماية الخصوصية على المحادثات والصور؛ حيث وسعت بنصوص حديثة نطاق هذه الحماية؛ وظهرت جرائم جديدة ومن ذلک جريمة تتبع الأشخاص في أماکن تواجدهم أو أماکن کانوا متواجدين فيها؛ وجريمة الإعتداء البصري على الأجزاء الحميمة الخاصة من الجسم باستخدام أي وسيلة تمکن الجناة من ذلک. وأظهرت اختلاف أحکام القضاء بشأن بعض التقنيات والتطبيقات التقنية، ومن ذلک الهاتف المحمول، الواتساب وما يماثله من تطبيقات، وترتب على ذلک اختلاف القانون الواجب التطبيق. وتجرم بعض الأنظمة التشريعية الإعتداء على الحياة الخاصة في قانون العقوبات فقط، ويجرمه البعض الآخر في قانونيين: العقوبات، وآخر خاص بمکافحة جرائم تقنية المعلومات، وأوضحنا اختلاف القانونين بشأن بعض الأحکام التي  تتعلق بهذا الاعتداء، ومن ذلک اشتراط المکان الخاص کمعيار للخصوصية، وعدم تقادم دعوى جريمة الإعتداء على الحياه الخاصة، وتقييد تحريک الدعوى الجنائية بتقديم شکوى من المجني عليه، والعقاب على الشروع، وبالتالي تتناقض القوانين في نظام تشريعي واحد في حکم مسألة واحدة، والحق المعتدى عليه واحد؛ وأوضحنا أن على المحکمة تحديد القانون الواجب التطبيق؛ حيث العقوبة في قانون مکافحة جرائم تقنية المعلومات أکثر شدة.

The sanctity of private life from the perspective of penal laws

Abstract :
The inviolability of private life was studied from the perspective of penal laws, a comparative study between several legislations, and the study found that it differs from the perspective of penal laws from that of other branches of law. Where, from the perspective of the latter, there may be acts that constitute an assault on privacy, but they are not subject to the provision of criminalizing the assault on privacy. Punitive laws no longer limit privacy protection to chats and photos; Whereas, in recent texts, it expanded the scope of this protection. New crimes appeared, including the crime of tracking people where they were or where they were. And the crime of visual assault on the private, intimate parts of the body by using any means that enables the perpetrators to do so. It showed the difference in court rulings regarding some technologies and technical applications, including the mobile phone, WhatsApp and similar applications, and as a result the difference in the applicable law. Some legislative systems criminalize assault on private life in the penal code only, and others criminalize it in two laws: penalties, and another for combating information technology crimes, and we explained the difference in the two laws regarding some provisions related to this abuse, including the requirement of the private place as a criterion for privacy, and the absence of statute of limitations of a case. The crime of assault on private life, restriction of criminal action to file a complaint from the victim, and punishment for attempting, and therefore the laws contradict each other in a single legislative system in the provision of one issue, and the right of the offender is the same; We explained that the court must determine the applicable law; Where the punishment in the Law on Combating Information Technology Crimes is more severe.
