ملخص الدراسة:
ظاهرة الأقليات تعتبر من أهم المشکلات التي تهدد الاستقرار العالمي للتباين العرقي واللغوي والديني لذلک تناول البحث موضوع الحماية الدولية لحقوق الأقليات، وتم إيضاح الأساس القانوني الذي تستند عليه أحکام القانون الدولي في ظل الاتفاقيات الدولية ثم أوضحنا الضمانات القانونية التي تعتبر بمثابة حجر الزاوية أمام انتهاکات الدول لحقوق الأقليات، من خلال بيان الضمانات الداخلية وبيان دور الضمانات الإقليمية والدولية وخاصة هيئة الأمم المتحدة ودورها في حماية حقوق الأقليات، کما يتطرق البحث للقواعد القانونية لجريمة الإبادة الثقافية، مع دراسة حالة أقلية الإيغور المسلمة في الصين، والروهينجا في بورما.
وفي النهاية يمکن القول إن مشکلة الأقليات هي مشکلة إنسانية بالدرجة الأولى ويجب التعاون بين أفراد المجتمع الدولي داخل الدول وخارجها من اجل حل مشاکل الأقليات ومحاسبة المسؤولين عن الانتهاکات والجرائم المرتکبة بحق الأقليات التي تقع بحقهم.

International protection of minority rights in international law "Uighurs and Rohingya as a model"

Abstract :       
The minority phenomenon is considered one of the most important problems that threat the global stability of racial, linguistic and religious differences. This is why this study dealt with the issue of the international protection of the rights of minorities, and clarified the legal guarantees that are considered the most important to States' violations of minority rights, by indicating the internal guarantees and the role of regional and international guarantees, especially the United Nations, and its role in protecting the rights of minorities. The study also dealt with the legal rules of the crime of cultural genocide, examining the situation of the Muslim Uighur minority in China and the Rohingya in Burma.
     Finally, it could be said that the problem of minorities is primarily a humanitarianone and that cooperation must be established betweenmembers of the international community within and outside States in order to solve the problems of minorities and hold those responsible for the violations and crimes committed against minorities.
