تطبيقات معاصرة لعوض الجاه

ملخص :
تناولت هذا الدراسة موضوع الجاه وعوضه وکان على ثلاثة فصول وخاتمة فالفصل الأول : کانت تحت مسمى مفهوم عوض الجاه ومتعلقاته جعلته على ثلاثة مباحث ، المبحث الأول درست فيها مفهوم الجاه وعوضه أما المبحث الثاني فتناولت فيه الالفاظ التي لها علاقة بعوض الجاه ثم کان المبحث الثالث نظرية المقاصد وعلاقتا بعوض الجاه ثم الفصل الثاني وتحت عنوان بذل الجاه وعوضه وأحکامه أحکام بذل الجاه وعوضه فکان في مبحثين الأول منهما تحدثت في عن تأصيل بذل الجاه وأهميته أما المبحث الثاني فدرست فيه حکم عوض الجاه وضوابطه أما الفصل الثالث المسمى تطبيقات معاصرة لعوض الجاه فهو في أربعة مباحث المبحث الأول منه ذکرت فيه الجاه العشائري وعلاقته بالعوض أما المبحث الثاني فتناولت فيه إعمال الوجاهة في الأعمال الخيرية والمبحث الثالث عرفت بحکم العوض في النفوذ الاقتصادي والسياسي وأخيرًا المبحث الرابع وهو التکييف الفقهي لبذل الجاه وعوضه ثم ختمت الدراسة بأهم النتائج التي توصلت إليه منها .
1-          الجاه تتطرقت لها کتب فقهائنا من حيث التنظير والتوجيه والاستفادة منه في الحياة العامة.
2-          الجاه ليس نعمة تقصر صاحبها على المنافع والمنازل الدنيوية بل هي لمن أحسن استخدامه طريق موصل إلى رضى الله سبحانه وتعالى.
3-          يعتبر فقهاء الأمة أن عدم استخدام الجاه في رفع حيف أو ظلم تجعل الشخص صاحب الجاه في مکان المساءلة وتضع عليه القصص والدية کما هو المشهور من قول السادة المالکية.

Abstract:
This study dealt with the subject of prestige and its place, and it was divided into three chapters and a conclusion. And the two relationships between the status quo and then the second chapter and under the title “Giving prestige and replacing it and its rulings,” the rulings on striving for prestige and replacing it. It was in two sections, the first of which I talked about the rooting of prestige and its importance. The second topic examined the ruling in place of prestige and its controls. The first of it mentioned clan prestige and its relationship to consideration. The second topic dealt with the realization of prestige in charitable work, the third topic was known as the rule of consideration in economic and political influence, and finally the fourth topic, which is the jurisprudential adaptation to give prestige and its compensation. Then the study concluded with the most important results that it reached.
1. Prestige has been dealt with in the books of our jurists in terms of theorizing, guidance and benefiting from it in public life.
2. Prestige is not a blessing that limits its owner to worldly benefits and homes. Rather, it is for the one who makes good use of it, a path that leads to the pleasure of God Almighty.
3. The jurists of the nation consider that not using prestige to remove injustice or oppression makes the person with prestige in a place of accountability and put parenting stories on him, as is well-known from the words of the Maliki masters.
