وباء کورونا والأحکام الفقهيَّة المُسْتجدَّة

ملخص :
فيروسٌ لا يرى بالعين المجردة، يأسر الإنسانية جمعاء، حيث دخلت به في حالةٍ من الخوفِ والفزع؛ کونه فتک بآلاف الأرواح في کُلِّ بلدٍ من بلدان العالم، فأغلقت الدولُ حدودها، وانهار الاقتصاد في کثير من البلاد، وتباطأت الحرکة التجارية في کُلِّ الجنبات المَعْمُورَة .
 وفي کثيرٍ من بلاد الإسلام والمسلمين توقَّف التعليم الوجاهي،ومُنِعَت التجمُّعاتُ خشية وخوفا ًمن العدوى، وانتقال المرض منْ إنسانٍ إلى آخَر، بل إنَّ البيتَ الحرام أُغلِقتْ أبوابه مع بداية الجائحة أمام المصلِّين والمُعْتمرين، فتوقَّف الطّواف والسَّعي، وأُغْلِقَ المسجد النَّبوي، وتمَّ تعليق الجُمُعَة والجماعات بناءً على الفتاوى الصَّادرة عن المجامع الفقهيَّة ودور الإفتاء، التي دعَتْ إلى ضرورة المحافظة على مقاصد الشَّريعة العليا، ومنها حفظ الأنفس والأرواح .
وبما أنَّ الصَّلاة هي روح المسلم وعصب حياته، آثر الباحثُ أنْ يکون عنوان بحثه ( وباء کورونا والأحکام الفقهيَّة المستجدة)، حيث تناول حکم تعليق صلاة الجمعة والجماعة في المساجد في ظل جائحة کورونا، وحکم الصَّلاة في المساجد مع الأخذ بالتدابير الوقائية الموصى بها طبيا ً؛ کتباعد المصلين في الصَّف. 
ومن أهم النتائج:
 أنَّ ما جرى مع بداية الجائحة على المسلمين من تعليقٍ للجُمَع والجماعات – خشية المساهمة في نشر وباء کورونا / کوفيد 19-  ليس استثناءً تاريخيا ًغيرَ مسبوقٍ؛ بل جرت نظائره في تاريخ أمتنا الإسلاميَّة؛ لأسبابٍ کثيرةٍ، ومنها ما کان لدواعٍ صحيَّة، وأن َّحفظ الدِّين لا يقومُ إلّا بحفظ النَّفس، وهذا ما نقله کثيرٌ منْ أشهر الأصوليين کالقُرَافي والرَّازي وغيرهم، وأنَّ المحافظة على أداء الصلوات الخمس ومنها الجمعة جماعة في المسجد أمرٌ ضروري، مع ضرورة تقيُّد المصلين بإجراءات التباعد، ولبس الکمامات؛ للوقاية من العدوى.

Corona Virus Pandemic and the new Juris Prudence Provisions

Abstract :
Corona virus, which is invisible, has capitivated the whole humanity and spread fear and scare among the global populations due to its fatal characteristic, which has resulted in the many deaths in countries all over the world such as China, Italy, Spain, Iran, and others. Thus, many countries have closed their borders. Moreover, this virus has a dramatic influence on commerce which has nearly callapsed and led to slowness in business.
Similarly,in many Islamic countries , education has stopped and gatherings have been banned for fear of spreading the infection and transmitting the disease from person to person . Even the sacred Al-kaba and the prophet's Mosque have been closed for prayers  and for those performing AL-Umrah.
Further more, AL-Twaaf and circumambulation has stopped In addition, AL-Jumah prayer and gatherings have been paused according to Fatawas issued by the Fiqh committees and councils which have called for preserving the superme goals of AL-shareeah, among them are preserving the souls and lives of people.
The researcher concluded the following:
* Banning AL-Jumah's prayers and the gatherings these days is for the sake of not spreading the pandemic of Corona Virus Covid-19. It is not an un precedent historical exception, Because similar cases took place through out our Islamic nation and for many reasons, some of them were similar to our present situation.
* preserving religion  can't be completed unless we preserve the lives and this belief was passed over to us through many jurists such as AL-Qurafi , AL- Razi and others .
