ملخص البحث:
تعتبر الهبة إحدى الموضوعات الحيوية التي تؤسس للتقارب والتواصل الاجتماعي، إذ يحمل تشريعها إظهار المحبة والود.
ويهدف هذا البحث إلى بيان مفهوم الهبة ومرتکزات تشريعها والموقف الشرعي من مفاضلة الوالدين في هبة بعض أولادهما، وما يتعلق بهذا الأصل من مسائل من خلال دراسة النصوص الشرعية الواردة في الکتاب والسنة، وتحليلها وبيان کيفية بناء الفقهاء لتلک النصوص وتطبيقها على المسائل.
أهم النتائج التي توصلت إليها في عدّة نقاطٍ.
1-          جاء الإسلام بالعدل في کل نواحي الحياة، ووضع قواعد وترتيبات لتحقيقه، ونهى عن الظلم وما يؤدي إليه.
2-          رغّب الإسلام في الهبة بين أفراد المجتمع؛ لتحقيق المودة والمحبة والتقارب بينهم.
3-          حثّ الإسلام على العدل بين الأولاد في العطية، وحذّر من عدم تحقيقه، لئلا يحدث الشّقاق بين الأبناء، وينتج عنه عقوقهم لوالديهم.
4-          الهبة عند الفقهاء عطية بدون عوض، ولا يخرج معناها الاصطلاحي عن معناها اللغوي.
5-          تنقسم الهبة لهبة عامةٍ مطلقةٍ وهبة بثواب وکلاهما ثابت.
6-          ظهر لي أنه لا يجوز المفاضلة بين الأبناء في الهبة ولو کانت المفاضلة لمعنى يقتضي ذلک، کمرض الابن أو کثرة عياله أو انشغاله بالعلم...، وإذا أراد إعطاء هذا الابن دون إخوته للمعنى الذي فيه، فإن عليه استئذان البقية تطييبا لخاطرهم.
7-          تحريم المفاضلة مقتصر على أولاد الصلب، ولا يشمل الأحفاد.
8-          المساواة بين الأبناء الذکور والإناث تکون برؤوسهم؛ لأنهم أبناء، والنبي صلى الله عليه وسلم قال: ((وَاعْدِلُوا بَيْنَ أَوْلاَدِکُمْ))، وهو يشمل الذکر والأنثى.
9-          إذا فاضل بين أبنائه ومات قبل مساواته بينهم، فإن هبته لا تُنقض، ويملک الموهوب له هبته، وکذلک لو وهب لأولاده، ثم رُزق بمولود بعد الهبة، فإنه لا يجب عليه مساواته فيما وهب لإخوته سابقًا.
إذا فضّل الأب أو الأم ولدًا لهما في الهبة على بقية إخوته، ثم أراد الرجوع في هبة هذا الولد المفضّل، فلهما ذلک إذا لم يتمکنا من مساواة البقية به بإعطائهم مثله، أو إشراکهم فيما وُهب له.

The Position of Scholars on Priority  Between Children Regarding Donation

Abstract:       
          Offering donation is considering one of the key factor that creates  and consolidates  relationship between the families where the juristic provisions of adhering and developing values of coalition and mercy will be met.
          The aims of this research explains the concept of donation, it’s pillars, legality and the position of scholars regarding priority among the children in addition to explosion to various issues derived or obtained from Holy Quran and Sunnah, whereby the researcher will analyses  the primary texts and explain the rule of Shariah Law.
The most important results I reached in several points.
1- Islam brought justice in all aspects of life, and established rules and arrangements to achieve it, and forbade injustice and what leads to it.
2- Islam desires a gift among the members of society; To achieve affection, love and rapprochement between them.
3- Islam urges justice between children in the gift, and warns against not achieving it, so as not to cause discord between children, and result in their disobedience to their parents.
4- The gift according to the jurists is a gift without compensation, and its idiomatic meaning does not depart from its linguistic meaning.
5- The gift is divided into a general and absolute gift and a gift with reward, both of which are fixed.
6- It appeared to me that it is not permissible to differentiate between sons in the gift, even if the comparison is for a meaning that requires that, such as the son’s illness or the large number of his children or his preoccupation with science..., and if he wants to give this son without his brothers for the meaning in which it is, then he must seek permission from the rest in order to pacify them.
7- The prohibition of trade-offs is limited to children of steel, and does not include grandchildren.
8- Equality between male and female children is up to them; Because they are children, and the Prophet, peace and blessings be upon him, said: ((And treat your children justly)), which includes both male and female.
9- If he chooses between his children and dies before he is equal to them, then his gift is not invalidated, and the gifted person owns his gift to him, and likewise if he gave to his children, and then had a child after the gift, then he does not have to equate him with what was previously given to his brothers.
10- If the father or mother prefers a son to them in the gift over the rest of his brothers, and then wants to take back the gift of this preferred son, they can do so if they are unable to equal the rest with him by giving them the same, or sharing them with what was given to him.
