الملخص:
هذا البحث محاولة للإجابة علىٰ الأسئلة التالية :
لماذا وصل المجتمع الدولي المعاصر إلىٰ واقعه الراهن، مع وجود الأمم المتحدة أو في ظلّها؟ ولماذا انحرفت العلاقات الدولية عن المسار الذي تضّمنه ميثاق الأمم المتحدة؟ وهل يمثّل هذا الانحراف انتصار السياسة الدولية علىٰ قانون المنظمة الدولية؟ أم الصلة الحقيقية بين الواقع الدولي وبين المثل القانونية التي بشّر بها الميثاق أکثر تعقيدًا مما يبدو في الظاهر؟
محاولة الإجابة علىٰ هذه الأسئلة قادتنا في طريق مزدوج: ملاحظة الواقع الدولي وسَبرْ غور النصوص. وأوصلنا هذا الطريق إلىٰ حقيقة أن القوىٰ المحرّکة للعلاقات الدولية تستمد من الميثاق نفسه ما يدعم حرکتها وأنها تجد في الميثاق قاعدة انطلاقها.
          هذا الطريق الذي قادنا إلىٰ هذه الحقيقة انطلق من الوقائع التأسيسية التي أفضت إلىٰ قيام الأمم المتحدة في العام 1945، ثم مضىٰ في ضوء هذه الوقائع يلتمس الصلة العميقة بين بنية الأمم المتحدة وبين بنية الحديثة ليجد العناصر الکبرىٰ التي قامت عليها الأمم المتحدة امتدادًا للعناصر الکبرىٰ التي قامت عليها الدولة الحديثة وليجد معول البناء الذي وضع الأساس متماثلًا هنا وهناک. وهٰهنا، في هذا التماثل العميق، رأينا العقدة التي تفسّر فشل الأمم المتحدة في تحقيق رسالة السلام التي أنشِئَت من أجلها. بيد أن معرفة هذه العقدة لم تکن نهاية البحث، بل امتدّ نظر الباحث إلىٰ أفق مستقبليّ يتحرّر فيه قانون المنظمة من القيد الذي يعطّل حرکته الحرّة نحو العدل والسلام الدوليين. هل الإصلاح ممکن؟ وما هو السبيل إليه؟ لا شک في أن تجربة التنظيم الدولي التي خرجت من الحربين العالميتين هي من الخطورة بحيث تتطلب إصلاحًا ينقذ الأمم المتحدة، ولا شک في أن جلال القانون الذي هو کهف الحقوق وملاذ البشر يدفع بقوة إلىٰ التماس سبيل الإصلاح. إنقاذ قانون الأمم المتحدة هو الغاية التي يتحرّاها هذا البحث المتواضع.

The United Nations and the philosophy of international organization

Abstract:
This research is a try to answer these questions:
Why did the contemporary international society reach to its current situation in-spite of the presence of the United Nations? Why did the international relations deviate from the path of the United Nations charter? Does this deviation represent victory of the international politics over the law of the international organisation?
We may ask whether the real relation between the international reality and the legal ideals which the charter heralds is more complicated than apparently? Trying to answer these question leads us to double way:
Noticing the international reality and probing the text . This way led us to the truth that the powers that move the international relations take their enforcement from the charter itself. Not only this but they find  in the charter the basic of their movement. This path which led us to this truth started from the founding facts which led to the establishment of the United Nations in 1945.
According to these facts it goes finding the deep relation between the structure of the United Nations and the structure of the modern state to find the big elements that the United Nations stood for are expansion to the big elements that the modern state stood for and to find that the pick of the construction which puts the basic is symmetric here and there. And in this deep symmetry we can notice the node which explains the failure of the United Nations to implement  the peace message which the United Nations was established for. Knowing this node was not the end of this research but the researcher goes far to the future when the organisation law will be free from the obstacles that stand against its free movement towards international justice and peace. Could the reform be possible and what is the path towards it?  It’s no doubt that the experience of the international organisation after the two worlds wars is so important that it needs reform that saves the United Nations, no doubt that the greatness of the law which is the cave of rights and haven for humanity pushes us to find the reform path. Saving the law of the United Nations is the aim behind this humble research.
