ملخص البحث:
تنبع أهمية المخطوط من أهمية الضوابط الفقهية ذاتها حيث أنها تلم شتات الجزئيات المتناثرة، وتمنح الذهن ملکة علمية وذلک بالاستقراء والاستنباط کما أن ضوابط القضاء تتبوأ مکاناً بالغ الأهمية لمن هم يعملون في سلک القضاء ومن ذلک رأيتُ أن حقق ضوابط القضاء من ضوابط الفقه للقاضي أبي البقاء الکفوي الحنفي (المتوفى1094هـ ) وقد قسمتُ البحث إلى مقدمة وقسمين: القسم الأول: القسم الدراسي: وفيه ترجمة المصنف والتعريف بکتابه والقسم الثاني: النص المحقق، وقد قمتُ بنسخ النص وفق القواعد الإملائية الحديثة، وتوثيق النصوص، وإخراج النص المحقق وفق أقرب صورة أرادها المؤلف.

The importance of the manuscriptAppears according to the importance of the jurisprudential Principles themselves while it gathers the scattered particles. Also, it gives the mind a scientific ability by induction and deduction. And, diplomas occupy a very important place for those who work in the judiciary field.
According to that I investigate the chapter of Judiciary (jurisprudential Principles (by Abu Al-Baqa Al-Kafwi Al-Hanafi (died 1094 AH).The research divided into an introduction and two section: The first section: The academic part: which includes the translation of author and the introduction of his book.
The second section: the investigated text, I copied the text according to the modern spelling rules, documented the texts, and produced the investigated text according to the closest image wanted by the author.
