ملخص البحث :
نوازل الأعمال الخيرية ومجالاتها تحتاج إلى عميق النظر في مراتب المصالح والمفاسد لتحقيق أعظمها نفعًا وأجرًا، ودرء أکثرها مفسدة وضررًا، وهذا التأمل هو ما يسمى الاجتهاد المصلحي. ومن هنا جاء هذا البحث من الناحية التأصيلية في بيان المراد بالاجتهاد المصلحي والتأصيل له، وبيان ضوابطه، ومن الناحية الاستقرائية بتتبع نوازل الأعمال الخيرية وتوصيفها، ومن الناحية التحليلية ببيان المستجدات في الأعمال الخيرية في ضوء الاجتهاد المصلحي.
نتائج البحث :
أولاً: أن الاجتهاد المصلحي مصطلحٌ اقتضته طبيعة البحوث العلمية، ويمکن تعريفُه بأنه: بذل الوسع في تحصيل الأصلح ودرء الأفسد في أمور الدين والدنيا.
ثانيًا: الاجتهاد المصلحي له دلائله من الکتاب والسنة وفعل الصحابة وأهل العلم.
ثالثًا: من ضوابط الاجتهاد المصلحي: العلم بمقاصد الشريعة ومراتبها، وأنه لا يکون بالتشهي ولا الهوى، کما أنه تتغير أحکامه بتغير مقتضيات المصلحة المتعلقة بأحوال الزمان والمکان والأشخاص، ولا بد أن يبنى على المصلحة المتحققة لا المتوهمة.
رابعًا: أن مصطلح العمل الخيري مبين عن نفسه، ويمکن القول بأنه: لفظ جامع لکل صور البر والنفع الذي يبذله المرء إلى الآخرين رغبة فيما عند الله عز وجل، سواء أکان هذا النفع ماديًّا أم معنويًّا، وسواء بذله بنفسه أو بغيره، وسواء علم عين مَن ينتفعُ به أو جهله.
خامسًا: نوازل العمل الخيري متعددة الصور، وکثيرة المسائل، وتحتاج لضبطها إلى اجتهاد يقوم على رعاية المصالح والمفاسد، وهو ما سمّاه البحث بالاجتهاد المصلحي.
توصيات البحث:

أوصي الباحثين والقائمين على الأعمال الخيري بالعناية بنوازل الأعمال الخيرية وتأصيلها وضبطها حتى تُؤتي الأعمال الخيرية ثمارها، وهذا الضبط ضرورة لنجاح هذه الأعمال واستمراريتها.
عقد مؤتمرات وورش عمل دورية تکون بمشارکة تخب المتطوعين والمتبرعين والجهات الرسمية الداعمة والمتابعة مع المختصين بالعلوم الشرعية لمعرفة مستجدات الأعمال الخيرية وأنظمتها الداخلية والخارجية.

Abstract:
We tend to consider the ranks of interests and evils to achieve the greatest benefits and reward, and to prevent the most corrupt and harmful, and this meditation is the so-called reformed jurisprudence. Hence this research came from a rooting point of view in the statement of what is meant by the reformed and authentic diligence, and the statement of its controls, and in an inductive way by tracking and characterizing the tendencies of charity, and analytically by showing the developments in charitable work in the light of the reformed jurisprudence.
research results:
First: A study of inference in the origin, reforming and warding off the corrupt in worldly matters.
Second: The conciliation ijtihad has evidence from the Qur’an, the Sunnah, and the actions of the Companions and the people of knowledge.
Third: Controls of interest-based diligence: knowledge of the purposes and levels of Sharia, as it is changed by changing the requirements regarding the conditions of time, place and persons, and it must be based on the realized interest, not the illusion.
Fourth: The term charitable work is self-explanatory, and it can be said that it is a comprehensive term for all forms of righteousness and benefit that a person gives to others with a desire for what is with God Almighty, whether this benefit is material or moral, and whether he exerts it himself or someone else, and whether the person is aware of it. He is ignorant of it.
Fifth: The calamities of charitable work take many forms, and many issues, and they need to be controlled by diligence based on taking care of interests and evils, which is what the research called interest-bearing diligence.
Search recommendations:
• I recommend researchers and those in charge of charitable works to take care of the calamities of charitable works, rooting them and controlling them so that charitable works bear fruit, and this control is a necessity for the success and continuity of these works.
Holding periodic conferences and workshops with the participation of volunteers, donors, and official supporting bodies, and following-up with specialists in Sharia sciences to know the latest developments in charitable works and their internal and external systems.
