إن ترتيب الأدلة المتفق عليها عند جمهور الأصوليين تسير على هذا النسق؛ الکتاب، والسنة والإجماع ، والقياس. ومن هنا تظهر أهمية القياس في حياتنا اليومية، وأن القياس مُظهر لحکم الواقعة الجديدة لا مُنشيء لها ، ومن هنا ظهرت منزلته في مراحله التاريخية ، وجميع الأحکام على مراتبها معلومة بالنص ، لکن بعضها يُعلم بظاهر النص ، بعضها يُعلم باستنباط وهو القياس ، ولو لزم أن لا يثبت حکم إلا بنص لبطل أکثر الأحکام المسدل عليها بفحوى الخطاب ، دليله ، ومن هنا يُعد القياس مصدرا من مصادر التشريع الإسلامي بل أوسع المصادر ، وعليه تقوم المسائل الفقهية الکثيرة ، لأن أکثر الحوادث لا نص فيها بحال ، فلو لم يُستعمل القياس لأفضى إلى خلو کثير من الأحکام لقلة النصوص وکون الصور لا نهاية لها . الکلمات المفتاحية : منزلة ، القياس من النصوص .
the standpoint of Analogy from the texts

The arrangement of the evidences agreed upon by the majority of Islamic fundamentalists follows this pattern. The Holy Quran, the Sunnah, unanimous agreement, and analogy, Hence the importance of analogy in our daily life. The analogy is a manifestation of the ruling of a new fact, not a constructor of it, from here, his status appeared in its historical stages. A ruling is established by a text either throughthe apparent meaning of the original text or by inductiveness of the content of the speech which is called “Analogy “. Hence, analogy is one of the sources of Islamic legislation, rather it is the most extensive source, and on it many jurisprudential issues are based, because most of the incidents have no text in any case. Provisions for the lack of texts and the fact that the images are endless. Key Words: Analogy , Standpoint .
