ملخص :
يهدف البحث إلى بيان مرونة الشريعة الإسلامية ومسايرتها للتطور في مجال العقوبات، والتعرف على مقاصدها في مجال العقوبات البديلة، وبيان ما شرعه الله للناس من شرع حکيم عادل له غايات وحکم ومقاصد وعللاً تصدر الأحکام عنها، ويبين البحث أن المقاصد والعلل والأحکام عليها مدار الفتوى وسياسة القضاة والحکام، وتؤول هذه المقاصد والعلل والأحکام في الجملة إلى حفظ المصالح التي تکمن في المقاصد الشرعية الکلية (حفظ النفس والدين والعقل والنسب والمال)، ويبين البحث ما شرع الله من العقوبات الزاجرة عن ارتکاب الحرام، وأن هذه العقوبات هي رحمة من الله تعالى تطهر الجناة.
وهذا البحث فيه معالجة لبعض القضايا المتعلقة بعقوبات التعزير البديلة وبيان المقاصد الشرعية منها، وبيان مساهمة التشريع العقابي في حفظ نظام المجتمع الإسلامي وتقويم ومعالجة الثغرات الأخلاقية والسلوکية، وذلک لأن الموضوع شديد الصلة بحياة الناس وأحوالهم وتطور أنماط عيشهم وتعاملاتهم وسلوکياتهم وأخلاقياتهم في الحاضر والمستقبل وفي کل ظرف.

Alternative punishments in light of the purposes of Islamic law

Abstract :
The research aims to demonstrate the flexibility of Islamic Sharia and its keeping pace with development in the field of penalties, and to identify its purposes in the field of alternative punishments, and to clarify what God has legislated for people from a wise and just Sharia that has goals, judgment, purposes, and reasons for which judgments are issued. And the rulers, and these purposes, causes, and rulings in general refer to the preservation of the interests that lie in the universal legal purposes (preserving the soul, religion, mind, lineage, and money).
This research deals with some issues related to alternative punishments for reprimand and clarifying the legitimate purposes of them, and an explanation of the contribution of punitive legislation in preserving the system of Islamic society and correcting and addressing moral and behavioral gaps, because the topic is very relevant to people’s lives and conditions and the development of their living patterns, dealings, behaviors and morals in the present and the future and in every circumstance. .
