ملخــص البحث
يُعالجُ البحثُ قضية من أهم القضايا في العصر الحديث، وهي قضية "حماية أماكن العبادة "؛ حيثُ باتت دُور العبادة تتعرَّض لانتهاكات في الواقع الدوليّ، في ظل غياب تطبيق أحكام الشريعة الإسلامية، وعدم الوفاء بالالتزام بموجب القانون الدوليّ الإنسانيّ، وقد كفلتْ الشريعة الإسلامية لغير المسلمين الحق في ممارسة العبادات التي تتفق مع عقيدتهم، والمحافظة على دور العبادة التي يمارَس فيها شعائرهم، وحرَّمتْ على المسلمين الاعتداء على بيوت العبادة وهدمها، أو تخريبها، سواء في حالتي السلم أو الحرب، بدليل بقاء أماكن العبادة التاريخية القديمة لليهود والنصارى في معظم ديار الإسلام والمسلمين، وقد جاء البحث في مقدمة وتمهيد وثلاثة مباحث، جعلتُ المبحث الأول في حماية أماكن العبادة في زمن السلم، وتحدثتُ عن مسألتين، الأولى تُعتبر من التدابير الوقائية لحماية أماكن العبادة، وهي مسألة حكم حمل السلاح في أماكن العبادة، ثم تحدثتُ عن حماية ممارسة الشعائر الدينية لغير المسلمين، وجعلتُ المبحث الثاني في حماية أماكن العبادة في زمن الحرب وتحدثتُ فيه عن مسألتين، الأولى في حكم القتال في الأماكن الدينية، وحكم قتال البُغاة فيها، والثانية جاءت في حماية الأماكن الدينية في حال استخدامها غرضًا عسكريًا، وجاء المبحث الثالث وجعلته في عقوبة انتهاك حرمة أماكن العبادة في الفقه الإسلامي، وطبعًا كل هذه المسائل تمت دراستها دراسة فقهية مقارنة.أسأل الله السداد والتوفيق
