بسم الله الرحمن الرحيم
الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبه ومن والاه وبعد
فهذا ملخص بحث تحت عنوان: (التفويض في الإيلاء والظهار والنفقات).
يختص البحث بدراسة التفويض في الإيلاء والظهار والنفقات وتطبيقاته في القضاء السعودي، وفق المنهج الاستقرائي الوصفي التحليلي المقارن، بجمع المسائل المتعلقة بالتفويض في الإيلاء والظهار والنفقات، ثم تصويرها وبيان أقوال فقهاء المذاهب الأربعة فيها، والمعاصرين، وأدلتهم، والمقارنة بينها وتحليلها مع محاولة ضبطها والتقعيد لها بما يجمع شتاتها ويسهل الحکم والتخريج عليها.
وقد انتظم البحث في مقدمة وتمهيد وثلاثة مباحث وخاتمة وفهارس.
اشتملت المقدمة على: مشکلة البحث، وأهميته، وأهدافه، ومنهجه وإجراءاته، وخطته.
أما التمهيد فاشتمل على تعريف التفويض والألفاظ ذات الصلة به وأنواعه.
المبحث الأول: التفويض في الإيلاء، وفيه مطلبان:
المطلب الأول: تعريف الإيلاء لغة واصطلاحًا.
المطلب الثاني: تفويض الإيلاء بمشيئة المرأة.
المبحث الثاني: التفويض في الظهار، وفيه مطلبان:
المطلب الأول: تعريف الظهار لغة واصطلاحًا.
المطلب الثاني: تفويض الظهار بمشيئة المرأة.
المبحث الثالث: التفويض في النفقات، وفيه ثلاثة مطالب:
المطلب الأول: تعريف النفقات لغة واصطلاحًا.
المطلب الثاني: استقراض الزوجة على الزوج إذا فوض إليها القاضي الأخذ من مال الزوج بغير إذنه، ولم يسم لها استقراضًا.
المطلب الثالث: حکم تفويض الزوجة غيرها بالقيام بالنفقات عبر الإنترنت أو المقطع الصوتي أو الفيديو.
واشتملت الخاتمة على أهم النتائج والتوصيات، ثم ألحقتها بأهم الفهارس الفنية المتبعة.
وصلى الله على نبينا محمد وعلى آله وصحبه أجمعين.

Delegating in Al-Ilaa’, zihaar, and expenses

Abstract:
In the Name of Allah, the Beneficent, the Merciful
     All praise belongs to Allah, the Lord of the Worlds, and peace and greetings be upon our messenger, Muhammad and upon his immaculate household, chosen companions and those who follow them well, until the Day of Judgment.
This is a summary of research under the title: (Authorization ila' (making an oath not to approach one's wife, Zihaar(A man says to his wife, “You are to me like my mother”) and expenses).
The research is concerned with the study of authorization -delegation- in ila', zihar and expenses and its applications in the Saudi judiciary, according to the inductive, descriptive, and comparative approach. By collecting issues related to delegation in ila', zihaar and expenses. Then photographing them and clarifying the sayings of the jurists of the four schools of thought, contemporary scholars , and their evidence. Then comparing and analyzing them with an attempt to control them with What brings them together and facilitates judgment and issue verdicts upon them.
The research was organized into an introduction, a preface, three chapters, a conclusion, and references.
The introduction includes: The research problem, its importance, objectives, methodology and procedures, and its plan.
As for the preface, it included the definition of authorization and the words related to it and its types.
The first topic: the delegation of Al-Ilaa’, and it has two parts:
The first part: Defining Al-Ilaa’ linguistically and terminologically.
The second part: the authorization of Al-Ilaa' based on the woman's will.
The second topic: delegation in zihaar, and it has two parts:
The first part: Definition of zihar, linguistically and terminologically.
The second part: authorizing the zihar at the will of the woman.
The third topic: delegation of expenses, and it has three parts:
The first part: the definition of expenses linguistically and terminologically
The second part: The wife’s borrowing from the husband if the judge authorized her to take from the husband’s money without his permission, and he did not name her a loan.
The third part: The islamic rule on authorizing the wife to another to carry out the expenses via the Internet, audio or video clips.
The conclusion includes the most important results and recommendations, followed by  the most important technical references used.
