ملخص البحث :
الأخذ بأقل ما قيل، دليل من الأدلة المختلف فيها لدى الأصوليين والفقهاء، وقد استدل الإمام الشافعى لبعض الفروع الفقهية في مذهبه بهذه الدلالة، وبنى عليها اختياره للمسألة، بينما رفض الاستدلال بها جماعة من الأصوليين والفقهاء، فترتب على هذا الخلاف، خلاف في الفروع الفقهية، وقد أصلت لهذه الدلالة أصوليا ببيان المذاهب الأصولية في الاستدلال بها مع بيان أدلتهم والمناقشات الواردة على أدلة كل مذهب، ثم عرجت على شروط الأخذ بأقل ما قيل عند من قال به، وبيان مرتبتها وموضعها من كتب الأصول، وحتى تتم الفائدة الفقهية فقد قمت باستقراء الفروع الفقهية التي يمكن أن تدخل تحت الاستدلال بهذه الدلالة وبيان مذاهب الفقهاء في تلك الفروع وأدلتهم مع التركيز على أثر هذه الدلالة في هذه الفروع، ورأيت أنه لا تتم الفائدة إلا بربط هذه الدلالة بالتطبيقات المعاصرة وبيان أثرها عليها فذكرت عدة مسائل من التطبيقات المعاصرة التي تندرج تحت هذه الدلالة كتقدير نصاب الزكاة بالأوراق النقدية وهل تقدر بالذهب أم بالفضة؟ وأثر دلالة أقل ما قيل على هذا التقدير إضافة إلى تطبيقات أخرى مذكورة في موضعها من البحث.

Abstract:
Taking at least one of the different evidence from fundamentalists and scholars, Imam Shafi alluded to some of the doctrinal branches of his doctrine in this sense, and based his choice on it, while refusing to be inferred by a group of fundamentalists and scholars, leading to this disagreement, a disagreement in the doctrinal branches. Having continued to make such an original statement of fundamentalist doctrines, together with the statement of their evidence and the discussions on the evidence of each doctrine, and then having regard to the conditions for the minimization of the statement made by the author, and the statement of their place and rank in the asset books, In order to be useful, I have extrapolated the branches of jurisprudence that can be inferred in this sense, and I have described the doctrines of scholars in those branches and their evidence, focusing on the effect of that connotation in these sections. I have seen that the benefit is only by linking it to contemporary applications and showing their impact on them, and I have mentioned several issues of contemporary applications that fall under this function, such as the assessment of etiology and banknotes.
