الحماية القانونية للبيئة الجوية من التلوث

       تتناول هذه الورقة العلمية الحماية القانونية للبيئة الجوية من التلوث كمشكلة تهدد الحياة على كوكب الأرض، حيث تناقش الجهود الوطنية والدولية التي بذلت في سبيل التغلب على هذه المشكلة، وتتناول التطور الكبير الذي طرأ على القوانين، والإتفاقيات، والمبادئ المتعلقة بحماية البيئة الجوية. وتعتمد الورقة على جمع واستخلاص المعلومات من مصادرها الرئيسية كالمراجع والرسائل والأوراق العلمية ونصوص الإتفاقيات الدولية، والقرارات والتقارير الصادرة من المنظمات المختصة وبعض التشريعات الوطنية، بغرض التوصل إلى نتائج ذات قيمة علمية ملموسة. ولعل أبرز تلك النتائج، هي أن تدخلات الإنسان عبر نشاطاته المختلفة قد أفسد النظام الدقيق للبيئة الجوية، مما استلزم ضرورة التدخل لإعادة التوازن. وإن ما بذل من جهود في سبيل المحافظة على البيئة الجوية، لا يتناسب مع حجم الدمار البيئي الناتج عن تلك التدخلات. بالإضافة إلى ان أنانية الدول العظمى فيما يتعلق بالإستغلال المفرط للموارد الطبيعية دون الأخذ في الإعتبار الآثار البيئية السالبة قد أدى الى تلوث البيئة الجوية. أما أبرز التوصيات فهي، تضمين حق الإنسان في التمتع ببيئة جوية معافاة في الدساتير والمواثيق الدولية. دعم ومساعدة الدول النامية ونقل التكنولوجيا النظيفة إليها. العمل على نقل الأحكام والمبادئ والإلتزامات الواردة في الإعلانات والمعاهدات الدولية إلى دائرة القانون الدولي الإتفاقي، حتى تكتسب صفة الإلزام ومن ثم تحريك دعوى المسؤولية على من يخالفها.

Legal protection of the air environment from pollution

Abstract:
This scientific paper deals with the legal protection of the atmospheric environment from pollution as a problem that threatens life on the planet, as it discusses the national and international efforts that have been made to overcome this problem, and deals with the great development that occurred in laws, agreements, and principles related to the protection of the atmospheric environment. The paper relies on collecting and extracting information from its main sources, such as references, theses, scientific papers, texts of international agreements, decisions and reports issued by specialized organizations and some national legislation, in order to reach results of tangible scientific value.
Perhaps the most prominent of these results is that human intervention through its various activities has corrupted the delicate system of the atmospheric environment, which necessitated the necessity of intervention to restore balance. The efforts made to preserve the atmospheric environment are not commensurate with the scale of environmental damage resulting from these interventions. In addition, the selfishness of the superpowers with regard to the excessive exploitation of natural resources without taking into account the negative environmental effects has led to pollution of the air environment.The most important recommendations are the inclusion of the human right to enjoy a healthy air environment in constitutions and international covenants. Supporting and assisting developing countries and transferring clean technology to them. Work to transfer the provisions, principles and obligations contained in international declarations and treaties to the Department of International Conventional Law, so that it acquires the status of obligation and then initiate a lawsuit of liability against those who violate it.
