الملخص:
يدرسُ هذا البحث مسألة عقد الاستصناع وأقوال الفقهاء فيها وبيان الراجح منها، وتهدفُ الدراسة إلى جمع الآراء المتعلقة بالمسألة والمتناثرة في كتب الفقه، كما تهدفُ إلى الوصول إلى الراجح في المسألة بعرض أدلة المجيزين والمانعين ومناقشتها، وقد جاءت مقسّمة إلى قسمين اثنين القسم الأول تطرق لبيان معنى الاستصناع والفرق بينه وبين التوريد والإيجار والسلم وأقسام الاستصناع، والثاني جاء فيه اختلاف الفقهاء في المسألة وأدلة كل رأي، كما تم فيه الترجيح بين الأقوال.
ومن أهم نتائج البحث أن عقد الاستصناع عقد جائز ولا يشترط له شروط السلم وإنما هو عقد مغاير للسلم والأمة الإسلامية تعمل به بلا نكير، وذلك من باب التيسير على الناس في المعاملات من جهة ومن باب رفع المشقة من جهة أخرى.

Abstract:
This research studies the metter of the Istisna’ contract and the sayings of the foqaha in it and clarifying the most correct of them. The study aims to collect opinions that are scattered in the books of fiqh. and reach the most correct by presenting and discussing the evidence of those who permit and those who prevent it, and it came divided into two parts. the first part touching on the meaning of istisna’a and his sections, and the second in which the jurists differ in the matter and the evidence for each opinion, as was the weighting between the sayings. And the results of the research is that the Istisna’a contract is a permissible and does not require the conditions of Salam, but it is a contract that is different from the salam and the Islamic nation operates in it without objection, and that is out of facilitating people in transactions and in order to relieve hardship.
