حقوق السائح وواجباته بالمملكة العربية السعودية: دراسة فقهية نظامية

المستخلص:
تتكلم هذه الدراسة عن المفهوم الشرعي والنظامي للسائح، ومفهوم السياحة المعاصرة، وعناية المملكة العربية السعودية بها، وأهم الأنظمة الحديثة المتعلقة بالسياحة، مع بيان حقوق وواجبات السائح في الإسلام بشكل عام وفي المملكة العربية السعودية بشكل خاص. وتهدف هذه الدراسة إلى تحرير مفهوم الحقوق والواجبات، وبيان حقوق السائح التي كفلها له الإسلام، وكذلك الواجبات التي ينبغي عليه الالتزام بها، وكيفية التعامل معه، مع توضيح أهم الأنظمة واللوائح الحديثة الصادرة من جهات الاختصاص فيما يخص السياحة والسائحين. واعتمد الباحث في دراسته على المنهج الاستقرائي والمنهج الوصفي كما هو موضح داخل هذه الدراسة، وقد خلصت الدراسة إلى جملة من النتائج كان من أهمها: -إن السياحة بمعناها المعاصر مختلفة تمامًا عن السياحة قديمًا، ومختلفة أيضًا عن مصطلحات السياحة الواردة في القرآن والسنة؛ فهي ظاهرة حديثة أدت إلى اهتمام وعناية الدول بها، لا سيما المملكة العربية السعودية التي أحدثت لوائحَ ونظمًا خاصة بهذا الأمر، وطورت من مؤسساتها الحكومية والخاصة؛ لمواكبة التطور الكبير في صناعة السياحة واستثمارها. -كما توصلت الدراسة إلى أن السائح بمفهومه المعاصر يمكن قياسه على المستأمَن في عرف الفقهاء، ويمكن قياس حقوقه وواجباته بحقوق وواجبات المستأمن في الإسلام، والتي ضمنتها ووضحتها له الشريعة الإسلامية،  وتكلم عنها الفقهاء في مواطنَ كثيرةٍ ومتفرقة من أبواب الفقه، وبينوا الطرق الشرعية في التعامل معه.

Abstract:
This study talks about the legal and legal concept of the tourist، the concept of contemporary tourism، the care of the Kingdom of Saudi Arabia with it، and the most important modern regulations related to tourism in the Kingdom، with an explanation of the rights and duties of the tourist in Islam in general and in the Kingdom of Saudi Arabia in particular. This study aims to liberate the concept of rights and duties، and to clarify the rights of the tourist guaranteed by Islam، as well as the duties that he must abide by، and how to deal with him، with clarification of the most important modern regulations and regulations issued by the competent authorities about tourism and tourists. In his study، the researcher relied on the inductive and descriptive method، as shown in this study The study concluded several results، the most important of which were: Tourism in its contemporary sense is completely different from tourism in the past، and also different from the terms of tourism contained in the Qur’an and Sunnah; It is a recent phenomenon that has led to the interest and care of countries in it، especially the Kingdom of Saudi Arabia، which has created special regulations and systems in this matter، and has developed its governmental and private institutions; To keep pace with the great development in the tourism industry and its investment. The study also concluded that the tourist، in its contemporary sense، can be measured against the custodian in the tradition of jurists، and his rights and duties can be measured with the rights and duties of the custodian in Islam، which are guaranteed by Islamic Sharia and made clear to him
