العملات الافتراضية حكمها، ودور الدولة تجاهها "دراسة فقهية مقارنة"

ملخص البحث:
في الوقت الذي انتشر فيه التعامل بالعملات الافتراضية، بل وفرضت فيه تلك العملات وجودها في سوق التعاملات المالية العالمية، كان من اللازم البحث في ماهية تلك العملات، والنظر في خصائصها وآثارها، لمحاولة الوصول إلى حكم شرعي تجاهها، وذلك من خلال النظر في قواعد الشرع ومقاصد الدين، وعمل موازنة بين إيجابيات العملات الافتراضية وسلبياتها، مع عدم إغفال التطورات المتلاحقة في نواحي الحياة المختلفة، والتي يأتي على رأسها في وتيرة التغير المستمر الجوانب المالية، فكان هذا البحث، والذي عني بالإجابة عن الأسئلة التالية: ما هي حقيقة العملات الافتراضية؟ وما حكم التعامل بها؟ وهل تعتبر عملة مالية بالفعل؟ وما هو واجب الدولة تجاه العملات الافتراضية؟
وكانت محاولة الإجابة عن هذه الأسئلة من خلال دراسة الموضوع من خلال المنهج الوصفي التحليلي الفقهي المقارن، وذلك بإعطاء تصور عن العملات الافتراضية وتحليل وضعها مقارنة بالعملات النقدية والحكم عليها من خلال جمع آراء الفقهاء المعاصرين ومؤسسات الفتوى في هذه المسألة ودراسة أدلة كل رأي بهدف التوصل إلى الرأي المختار منها.

Abstract:
 
At the time where transactions using virtual currencies spreads, It was necessary to examine the nature of these currencies, and look at their characteristics and effects, to try to reach a legitimate ruling towards them, by looking at the rules of Sharia and the purposes of religion, and conducting a comparison between the advantages and disadvantages of foreign currencies, as well as not forgetting the successive developments in various aspects of life, foremost of which are the financial aspects. Therefore, this research is interested in answering the following questions:
 
What is the reality of virtual currencies? What is the ruling on dealing with it? Is it really a financial currency? What is the duty of the state towards virtual currencies? The attempt to answer these questions was through the study of the subject through the comparative descriptive jurisprudential analytical methodology by giving a view and concept on the virtual currencies of and analysis of their status comparing to monetary currencies and judging them pursuant to the views of contemporary jurists and the institutions of fatwa in this matter as well as studying the evidence of each opinion in order to reach the correct one
