ملخص البحث:
مما لا شك فيه أن الوظيفة العامة شرف كبير لمن يتقلد أعبائها، فقبل أن تكون تلك الوظيفة مجرد عمل يؤديه الموظف بمقابل مادي، تعد في جوهرها تكليف لخدمة وطن، يظفر بحمل لوائها من تضع فيه الدولة ثقتها كلاً بحسب اختصاصه وخبراته.
      إن الموظف العام وهو في صدد ممارسته لأعمال الوظيفة العامة يعد بمثابة أداة الدولة ووسيلتها في تنفيذ سياساتها المختلفة في كافة المجالات.
وهذه الصفة تجعل الموظف العام مستودعاً للعديد من الأسرار الخاصة بالجهة الحكومية التابع لها، ومطالب بالمحافظة على هذه الأسرار وعدم إفشائها؛ وذلك تحقيقاً لمصالح الدولة وأهدافها.
     يعد التزام الموظف العام بحفظ ما يعهد إليه من وثائق ومعلومات من أهم الالتزامات الوظيفية التي يترتب على مخالفتها وقوعه تحت طائلة المساءلة الجنائية، وذلك لما يترتب على إفشاء هذه الوثائق والمعلومات السرية من إحداث أضرار تمس بأمن الدولة ومصالحها.
     سنقوم بتقسيم دراستنا لهذا الفصل إلى مبحثين، وهي كالآتي:
المبحث الأول: الموظف العام في الفقه الإسلامي
المبحث الثاني: الموظف العام في الأنظمة المعاصرة

Abstract:
There is no doubt that a public position is a great honor for those who assume its burdens. Before that job is just a job performed by the employee in return for a fee, it is, in essence, an assignment to serve a nation, whose banner is won by those in whom the state places its trust, each according to his specialization and expertise.
 
      The public employee, while he is in the process of exercising the work of the public office, is the state's tool and means in implementing its various policies in all fields.
 
This characteristic makes the public employee a repository of many secrets of the government agency to which he belongs, and he is required to preserve these secrets and not disclose them; In order to achieve the interests and objectives of the state.
 
The obligation of the public employee to keep the documents and information entrusted to him is one of the most important job obligations, the violation of which results in his being subject to criminal accountability, because of the consequences of disclosing these documents and confidential information of causing damage to the security and interests of the state.
We will divide our study for this chapter into two sections, which are as follows:
The first topic : the public servant in Islamic jurisprudence
The second topic : the public employee in contemporary systems
