يمثلالفسادبکافةأشکاله وأنواعهإحدى المشکلاتالتيتؤديإلىعرقلةالغايةالتيتسعى الدولةإلىتحقيقهامنوراءإنشاءالمرافق العامة،ولذلکوجبالتفکيرفيخلقحمايةفعالة تضمنحسنسيرالمرافقالعامة،فجرائمالفسادتؤثرعلىالأداءالماليوالإداري وأداء المرافق العامة ،وتتسببفي إهدارالمالالعاموتعطيلالدولةعنمباشرةنشاطاتهاأووظائفهاالمختلفة،وهومايؤثرعلى مصلحةالفردوالمجتمع. والمشرعالکويتيکونهأدرکهذهالأهمية،دفعهإلىتخصيصقانونيحکمهاوينظم سيرعملهاوإدارتهاوحمايتهامماقديعيقهاعنتحقيقالغاياتالمنشودةمنها،بإيجادالآليات والأساليبالتييقمعبهاهذهالجرائم،هذامايظهر في إصدار قانونالهيئة العامة لمکافحة الفساد والأحکام الخاصة بالکشف عن الذمة المالية رقم (2) لسنة 2016.
Abstract
Corruption in all its forms and forms is one of the problems that impede the purpose that the state seeks to achieve through the establishment of public utilities. Therefore, it is necessary to think about creating effective protection to ensure the proper functioning of public utilities. Corruption crimes affect the financial and administrative performance and the performance of public utilities. The waste of public money and the disruption of the state from the start of its various activities or functions, which affects the interests of the individual and society. The Kuwaiti legislator, realizing this importance, pushed it to allocate a law that governs and regulates its functioning, management and protection, which may hinder it from achieving its desired objectives by finding the mechanisms and methods that repress these decisions. This is reflected in the issuance of the General Anti-Corruption Law (2) for the year 2016.
