ملخص البحث:
تعد دراسة تغير الفتوى من صميم المسائل المعاصرة لما استجد من مسائل وحصل من نوازل، ولأن الفقه متجدد والمسائل الفقهية لا تنحصر، فقد وضع العلماء قواعد عامة لضبط الفتوى، ولضمان عدم خلو الوقائع عن أحکام شرعية، وهذا ما عبر عنه العلماء بکون النصوص الشرعية متناهية والمسائل غير متناهية، ولکن لازالت هنا بعض المسائل الأصولية التي بحاجة لنظر من المتخصصين، ومنها هذه المسألة التي نحن بصددها، وهي هل التغير المطلوب لملائمة قصد الشارع، هو تغيير في الفتاوى أم تغير في الأحکام؟ وهذه هي مشکلة البحث الرئيسة؛ لأن التشريع يتناول الفتوى والحکم الشرعي، وما هو الفرق بينهما؟ وما هو الثابت منهما وما هو المتغير؟ إلى غير ذلک من أسئلة يحاول هذا البحث الخروج بإجابات لها، واتبع الباحث في البحث المنهج التحليلي الاستقرائي المقارن، وقد توصل الباحث إلى نتائج من أهمها: أن للمفتي شروط يجب مراعاتها لتجنب الزلل في الفتاوى، وأنَّ هناک فرقاً بين تغير الفتوى من جهة والنسخ والتقييد والتخصيص من جهة أخرى، وأنَّ الفتوى مهمة في حياة المسلمين بل هي أهم من إقامة معايشهم الضرورية، وأنَّ العلماء قد استنبطوا دليل تغير الفتوى من الکتاب والسنة والإجماع والعقل وفعل الصحابة، وأنَّ التغير المنصوص عليه في قواعد الفقه والأصول هو تغير للفتوى وليس تغير للحکم الشرعي، ولکن جرى التعبير عن الفتوى بالحکم الشرعي تساهلاً.

The study of changing the fatwa is at the heart of the contemporary issues of the new issues and has been denied, because the jurisprudence is renewed and the jurisprudential issues are not limited. The scholars have established general rules to control the Fatwa and to ensure that the facts are not devoid of legitimate rulings. But there are still some fundamental issues that need to be considered by specialists, including the question we are dealing with. Is the change required to suit the purpose of the street a change in fatwas or a change in rulings? This is the main research problem, because the legislation deals with fatwa and shar'i ruling, and what is the difference between them? What is fixed and what is the variable? To other questions, this research attempts to come up with answers, and follow the researcher in the research method of analytical inductive comparative, the researcher And that there is a difference between changing the fatwa on the one hand and copying and restriction and allocation on the other, and that the fatwa is important in the lives of Muslims, but is more important than the establishment of their necessary living, and that scientists have developed a guide to change The fatwa of the Qur'aan, Sunnah, consensus, reason, and the Sahaabah. The change stipulated in the rules of fiqh and the fundamentals is a change to the fatwa and not a
change to the Islamic ruling.
