الملخص:
هدفت الدراسة الى تقصي الحصانات المقررة للبعثات الدبلوماسية الدائمة بموجب اتفاقية فيينا للعلاقات الدبلوماسية لسنة 1961، وتحديد مفهوم التجسس الصادر من البعثات الدبلوماسية الدائمة وطرق مواجهة تلك الظاهرة على المستوى الداخلي والدولي. حيث تم تناول مفهوم البعثات الدبلوماسية الدائمة والغرض منها ومهامها ومبررات منحها الحصانات، كما تناولت تحليل ابعاد استغلال الحصانات الدبلوماسية لغايات القيام بأنشطة تجسسيه تؤثر على استقرار الدولة الموفد إليها وامنها الوطني. وأشارت هذه الدراسة إلى أن التجسس الدبلوماسي يشكل اخلالاً بالالتزام الدولي المترتب على البعثة الدبلوماسية وأعضائها؛ والمتمثل بضرورة احترام القوانين والأنظمة وعدم التدخل في الشؤون الداخلية للدولة المضيفة.

The Espionage of Permanent Diplomatic Missions under International Law

Abstract:
This study aimed to investigate the assessed immunities to permanent diplomatic missions according to Vienna convention on diplomatic relations, which were done on 1961, and to define the concept of espionage issued from permanent diplomatic missions and the ways to confront that phenomenon on the internal and external level. Where the concept of permanent diplomatic missions, their purpose, tasks and justifications for giving them immunities were discussed, it also dealt with an analysis of the dimensions of the exploitation of immunities for carrying out espionage activities that affect the stability and national security of the state. This study indicated that diplomatic espionage poses a breach of the international obligation of the diplomatic mission and its members represented in the necessity to respect the laws and regulations and not to interfere in internal affairs of the host country.
