الملخص:
يتناول هذا البحث جمع ودراسة المسائل الأصولية في الحكم الوضعي، التي أوردها ابن النجار في كتابه معونة أُولِي النُهى.وقد اشتمل البحث على مقدمة وتمهيد وثلاثة مباحث وخاتمة، أما المقدمة فتتضمن مشكلة البحث وأهميته وأهدافه، وأما التمهيد فتضمن تعريف بابن النجار وكتابه معونة أُولي النهى، وأما المباحث فتتضمن المبحث الأول خمسة مسائل في السبب وتضمن المبحث الثاني ستة مسائل في الشرط والمانع وتضمن المبحث الثالث خمسة مسائل في الأداء والقضاء والعزيمة والرخصة. وأما الخاتمة فتتضمن النتائج التي توصل لها الباحث وهي: عدد المسائل الأصولية التي أوردها ابن النجار في الحكم الوضعي خمسة عشر مسألة، وقد اتفق رأي ابن النجارمع ما ذكره في شرح الكوكب المنير في أربعة عشر مسألة، وخالف في مسألة تعريف الشرط.

The Fundamental Issues Contained in the Provided Judgment (Al-Hokm Al-Wadey) in the Book of Ma`wnaUli Al-Nuha - by Ibn Al-Najjar - Collection and Study

Abstract:
This research deals with the collection and study of fundamental issues in positional law, which were mentioned by Ibn Al-Najjar in his book Ma'unatOli Al-Nuha. The research included an introduction, a preamble, three research studies and a conclusion. The introduction includes the research problem, its importance, and its objectives. As for the preamble, it includes a definition of Ibnal-Najjar and his book, “Ma'unatOli Al-Nuha.” As for the research studies, the first research which includes five issues in the reason. And the second research included six issues of the condition and the deterrent. The third research included five issues in performance, judiciary, determination and license. As for the conclusion, it includes the results reached by the researcher: which are numbers of fundamental issues that Ibn al-Najjar mentioned in the positional law which are fifteen issues , and Ibn al-Najjar’s opinion coincide with what he mentioned in the explanation of the "Al- Kawkab Al- moneer" book in fourteen issues, and he disagreed with the issue of defining the condition..
